Why not apply for 2008 tax return after spouse gets here?

Hey VJ friends,

I've read several posts about getting ITIN # for 2008 tax returns. I was wondering why people are not waiting for their spouse to get here and then apply for tax returns. My plan is to apply for tax extension, which gives me till October 15, 2008 to file return. Since I am at the end of the NVC process, I am hoping my husband will be here by then and then we apply for tax return with his SSN#. i did lot of times that spouse are asked for 2008 tax return paper during interview time. So, I did emailed our embassy (Chennai, India) and they said that the copy of extension form with a letter from beneficiary explaining why tax were not filed are sufficient at the interview time. Of course, we will take a copy of the email as well..

So, am I missing something? Makes me nervous because no one is doing what I plan to do and I am thinking I am missing something.... Specially since I've never done my taxes by myself and have very little knowledge of how tax thing works....

Some people do it to get part of the refund sooner, It is ok to wait, but be sure to have 2008 W-2's & 1099's, also pay stubs, and the letter of employment. Good Luck, Mike & Yizhen

Timeline

Remember that if you owe taxes, then you must pay by April 15th but can still file later. You will be assessed penalties if you pay after April 15.

If they owe you money, then you can wait. The government will gladly make more interest on your money.

I wouldn't think the spouse would qualify for the 2008 stimulus as he was not a resident alien for any part of the year. Having a valid SSN is only part of the equation.

You're right, wanted to file Married Filing Jointly. My accountant told me that I can qualify since I was married in 2008. Frankly speaking, I really don't know enough about taxes to know what I want to do... so for now, I file for extension...later on, dig up bit more about this topic and figure out what I want to do. In the worst case scenario, I find out I can't find Jointly or that my husband will need to get ITIN or something like that... I'll be ok with that. Right now, running short on time for April 15th deadline so might as well just go with extension and look into this later on... no harm right?

Yeah ur right no harm.Just make sure you pay whatever u owe before Apr 15th and send proof of payment to ur hubby incase he needs it in interview.

We're married year 2005 and my husband filed his income tax for year 2005 as Married, Filing Separately (the H&R Block indicated my name as the spouse in the return and put SSN in process) since I'm not yet in the US and have no ITIN. He was not able to file his 2006 tax return (I already figured out that we will not owe taxes) and I arrived in the US on 2007. As long as you don't owe taxes, it's not a problem if you file later.

Last January 2008, I filed both tax returns (for years 2006 & 2007) Married, Filing Jointly since I already have my SSN. The IRS don't have any problem with that, they sent our tax refunds intact for both years and give us more for the additional child tax credit for our baby who was born Dec, 2007.

I brought the years 2003, 2004 & 2005 tax returns, certficate of employment, W2s for taxable year 2006 and other financial docs for my interview last January 2007. They just look at the current financial status and didn't bother much for the previous years.

The petitioner qualifies by income for the stimulus, if he is married and his spouse has a SS#, then he would also get the stimulus for her, Resident Alien or not. My wife is here in the US on a K-3 without a SS#, we will file an amended return as soon as she gets the SS#. Mike & Yizhen

For tax purposes your spouse is considered a resident if you were married at the end of 2008(if you chose so), even if they never lived in the US.

You can file Married Filing Jointly, no problem. Also since your spouse is outside of the country on April 15, you get an automatic extension until June 15 to FILE and PAY. When you submit your tax return by June 15, you have to attach a letter saying your spouse was away on April 15.

Otherwise if you file the form for extension, you have to icnlude your spouse on it if you intend to file jointly and them not having SSN or having it under their maiden name could cause a delay in processing.

You can talk to the IRS, explain the situation and they will tell you exactly what to do. Operators are very knowledgable and helpful.

As an FYI...the consulates have the right to ask for 2008 returns during the interview. In my case, I filed my 2008 return and will ammend it later once my wife gets her SSN.
