Hi

I am going through AOS and expect my AP within a few weeks. As soon as it arrives I wish to return to the UK for a couple of weeks to visit aged relatives. Does anyone know of potential problems with readmission to the US using the AP ir is it as streightforward as it should be?

only real problem is if you have had previous overstays

Yep, this is the case with a person who enters the USA on a K-1 marries, and then does not file to adjust status until they are MORE than 6 months past their I-94 expiration date.

I filed for AOS about five weeks after my I 94 expired so I should be ok?

MORE than 6 months

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Where do you find documentation that gives a specific period of time (ie MORE THAN 6 MONTHS) after expiration of I94 by Which time AOS needs to be filed? I am not aware of any specific time frame. My understanding is that once AOS is submitted and NOA is issued, you are officially in a protected status regardless of how long it had been since your I94 previously expired.

I just used my AP a few days ago, drove to Canada stayed 2 weeks drove back. It's really smooth and easy, it took awhile because they were busy in secondary. But don't worry, you'll be fine! They'll take your I-94 and put a new one in your passport. Have a wonderful trip home!
