Divorce before lifting conditions

Hi!

I am in a real catch 22.

I am a permanet resident (2yrs conditional GC) I am getting divorced... In October, my green card will expire; I don't know If I will have my divorce decree by the time that I should apply to remove conditions + waiver. I know that USCIS gives 90days before the card expires to remove conditions and if the conditions are not removed before the card expire you have to explain why I didn't aplied before...

My relationship went to S!@%^ after saying: I do! we werer 1year + 3 months married and 4years together. Me and my husband lived with his parents, his family drove me insane, he dint wanted to get a place on our own and we were arguing all the time.

I have a huge stack of papers that is a bona fide marriage, pictures, joint bank accounts, joint Health insurance, joint credit card, cards (wedding, aniversary, christmas, valentines) from friends and family with both our names. But no kids, no property, no utilities bills or any joint ownership. But I think the prooffs I got will be enough.

I don't want to come back to my country I have my life already builted here: a good job here, friends and my own place. I don't know what to do if they deny my case.

If my case is denied what choices do I have?

Can I marry againg and adjust my status? or will i have to get back to my country?

Does anybody here had or have a similar case?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

we're missing something here :unsure: ..nways, you can file as soon as you get your decree. Even if you pass the 90 days period, it could be explained to the USCIS for the untimely filing of your I-751. As long as you provide the USCIS an affidavit or letter that explains why plus a copy of your pending divorce proceedings, you'll be ok. If you plan on getting married again then that's your prerogative..
