Hello everybody,

I just have a few questions and seems like i'm at the center of knowledgable people.

so,

my sister has moved to states and is living with me. I support her and she is going to school in seattle with me. I'd like to sponsor her to get a green card. I'm a US citizen and would like to file for this process.

Do i only need to file an I-130 or are there any other forms that i should file?

When i checked it was saying that the process takes almost 10 years. is that real? is there a possible way to speed the process up (i'm sure many people ask for that).

I'm also thinking about applying for my parents should i do all of them at the same time? Do i need any extra forms for my parents? (they resite at a different country) and Do i pay the fee seperately for each person?

One last question; would it be a faster process if i sponsor my parents and then they sponsor my sister?

If you file a I-130 for your sister it is going to take a very long time, about 11 years for a visa to become available to her, you say she is in school here, once her student visa has ended she will not be able to remain in the US for the rest of the time she will have to return to her own country and wait for the visa to become available.

To file for your Parents you need to submit the I-130 for each parent along with the evidence that is needed, that is the 1st step once the I-130 has been approved the case will move to the NVC and there are other form to be completed at that time. Once the NVC are finished the case gets sent to the embassy for interview and medicals. That will take about 1 year for them to get a visa to move to the US. The could file for their daughter to come to the US, if she is over 21 and unmarried it would take about 9 years for the daughter to get a visa as long as she remains unmarried. If your barents go on to become citizens (5 years after entry) then they can upgrade your sisters application and that will cut about 2 years off the wait time.

There is no fast way to get your sister here to stay. Just make sure that she leaves the US when her student status ends as any overstay will not help her get any sort of visa in the future.

You should file for your sister anyways. Your parent can file for her once they are LPR (green card holders - legal permanent residents). It is permissible to have multiple petitions for one individual. If your dad files for your sister and he dies, the petition would automatically be denied. If you file a petition as a backup to your dad's petition for your sister, you would not have to start from the beginning if something unfortunate happens to your dad.

The horror story is of a US citizen guy who petitioned for his dad. His LPR dad file for his sister. 5 years pass and dad is killed in an accident. Without a backup, the brother has to file a petition and it is a 11 years wait at that point. With a backup, the sister only has to wait 6 more years.

$355 is cheap insurance.

Having a I 130 o/s could comprise her nn immgrant F 1 Status if she has to renew it and it otherwise comes up.

I read in several threads that the I-485 can be filed concurrently with the I-130, so you don't have to wait for the approval notice from the I-130. Is this right? So in essence you can just remain in the States without a visa as your AOS is pending? Even if it takes 10 years? As I read in another thread (Can I file For I-485, while I-130 Is Pending?):

The I-485 should have been filed along with the I-130, as you did not do this you need to file the I-485 and include a copy of the NOA1 for the I-130. You do not need to wait until the I-130 has been approved. once the I-485 has been filed your status becomes AOS Pending and you will not need to maintain your H1 visa to remain in the USA.

For a spouse or parent of a US citizen who are classified as Immediate Relatives. Not for a sibling who would be in the F4 preference category, otherwise why would anyone wait outside the US for 10+ years?
