Hi...everybody

After I tried to find out about this.I've never get the answer so I decided to post my question here.This is my story.

I and my hubby decided to move back to usa.We have a kid togerther who is almost 2 years old now. (He has b/c and us. passport)

And our case need joint-sponsor because his income cannot meet the poverty guideline so we asked

his dad to be joint-sponsor and the question is !!

Does joint-sponsor need to put my son on the immigrant you are sponsoring too? ( where it say is on Part3. of I 864)

I'm very confused now because somewhere said " no need too" my son is citizen. Can anybody give me the answer please ?

But he is counted as part of the household.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The husband and the son are USC. Not in need of sponsorship. The wife is the immigrant being sponsored. The husband will complete the I-864 with a household of 3. If his income is below $22,887 then a joint/cosponsor for the wife will be needed.

The cosponsor needs to satisfy the income requirements for their household plus the immigrant(s) sponsored. The USC husband and son are not considered in the cosponsor's calculations unless the husband and/or son are part of the cosponsor's household.

Did the father-in-law of the immigrant claim his son (petitioner) and/or grandson his 2008 tax return? If not then petitioner and grandson are not included in the calculations.

No father in law didn't claim his son (petitioner) and/or grandson his 2008 tax return.Actully I and my husband live in thailand now and father in law live in usa. My huhsband live in thailand for almost 3 years.So He is my first sponsor right ? but his income cannot meet the

income requirements so we need his dad to be a joint-sponsor. so my husband and my son no need to count in father-in-law. This is what i understand. my husband has a house in usa. well more I read more I got confused

No, your father in law counts his household and adds just you as the immigrant. It doesn't sound like your husband and son are included in father in law's household. Your husband does fill out an I-864 form

Thank you very much everybody. I and my husband feel alot better .I have one more question because my husband 's not sure about this. My father-in-law has a daughter but she isn't at the same house.She live somewhere else for a year now.She is 18 years old. Does father-in-law need to count her too?Because she's not 21 years old yet. Sorry guy for have too many question Edited by tisa_ying

Did he include her on his tax return last year? If so, he is likely responsible for claiming her on the 864

I called to him last night and he said yes he include her on his tax return...so my husband said he can't be a co-sponsor for us

because his income cannot meet the income requirements for 5 ppl :crying: . So now we have my hubby's friend become a

co-sponsor instead father-in-law.We read from the 864 instructions that a co-sponsor can be any U.S. citizen who is at least 18 years old. We can do that right?

Here is some information about my hubby's friend

-He's married and has no kid.

-He filed the tax separated with his wife ( just him and his wife in the house)

So How many ppl he has to counts just him and I right? Hope you guys can give me an idea please !

yes you can use the friend, and he only lists the immigrant and himself. the friend need not list his spouse, unless he is using the spouse's income to qualify as well.

Thank you very much "txladykat" so now I can ask my hubby's friend to send us for all the papers we need. thank you very much.
