Did it ask you if you'd never been convicted of a crime in general? That wouldn't make sense... only certain crimes render one ineligible to petition for an alien fiancee. You could have stolen as many cars as you wanted and they couldn't deny you. Not that I'm saying you steal cars, I'm just saying if you did... ;)

Anyway, was it this text?

2. Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes:

  • Domestic violence, sexual assault, child abuse and neglect, dating violence, elder abuse or stalking. (Please refer to page 3 of the instructions for the full definition of the term "domestic violence.)
  • Homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking, peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment or an attempt to commit any of these crimes, or
  • Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.
Answering this question is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a record. Using a separate sheet(s) of paper, attach information relating to the conviction(s), such as crime involved, date of conviction and sentence.

That's Part C, #2 on page 3 of the I-129F. A lot of people forget to tick "no," and it generates an RFE. This is a fairly common one, as I understand it.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

From what I hear it's a common mistake, it's a little tiny box that is very easy to overlook. You should be laughing! Better to laugh than cry, and it's a simple thing...thank God :D I probably wouln't of appreciated him laughing either since he's being paid to check you documents...but there's nothing you can do about that now. It will be fine, you'll see!

Yes Im happy thats all it was but you are right,I was not happy because I payed him to make sure it was done right, but now I read that lawyers make more mistakes with this stuff then if we do it our self.I think its because he has nothing invested, its not any body he loves so he could care less as long as your check clears.

My ex is a legal secretary.. the lawyers do little to nothing.. she does the whole thing and in some cases wrote his presentations to the court.. (what would be said to the jury or judge...) so the mistake was likely the legal assistants mistake... sucks that your relationship is likely in the hands of someone making 10 or 12 bucks an hour and not the attorney that was hired.. but thats how they do things...
