My visa F1 is going to expire after I marry my fiancee, should I apply for a visa B2/H2B since we have no money to file for AOS right now?

05/01/09 - Married in the city of San Francisco.

05/17/09 - 05/21/09 - Preparing papers - (i-130, i-864, i-485, i-765, i-693, g-325a).

05/22/09 - Mailed out papers (Priority Mail - since its Memorial Day Weekend)

05/26/09 - Papers delivered @ 9:06 AM and signed in Chicago by JH

06/03/09 - Checks got cleared after 8 days.

06/05/09 - Received NOAs for I-130, I-485, I-765, I-131

06/12/09 - Received BioMetrics letter. :) Hurray!

06/31/09 - AP Approved

07/01/09 - EA Approved & Card production ordered

07/06/09 - Received AP

07/08/09 - Interview Set for 08/20/09

08/20/09 - Interview and got APPROVED

Overstay is generally forgiven under these circumstances :

as long you entered USA with no intention to immegrate,

your marriage looks very valid,

You didnt marry too fast after entering. There is a 60/90 rule. Not within 60 days but before 90 days or before expire of your present visa is ok.

And you entered usa under proper inspection.

Many a people here has adjusted here after years of overstay. Its never looked upon. Look at my timeline. I cdnt apply for AOS till almost a year as I didnt have the money.BUt i was married two or three days before my B1/B2 expiery. But applying for tourist visa is not a option for you especially when you wd apply for a AOS after that.

March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC

6/6/11 - Biometrics done

All I am trying to say is that it shd not look that you opted to do AOS as you have overstayed. To my research finidings thats where problem begin and the imm officers ask more where the alien has overstayed and then married and done aos. BUt marrying before the visa epired and then cdnt file AOS due to some good reason, makes sense. Others may give you some more advice. I wish Pushbrk gives some advice here.

on Form I-485,you should enter the name of the visa she came in and put actual expiration date. See this attorney at law answering here

Just dnt run into any trouble while you are overstaying.If any cop stops you and sees your passport and the overstay you may be applicable for deportation. So be careful about those things. Otherwise you wd be fine so long you are married before your visa expiery.
