I was reading up on the I-864 and discover I HAVE to claim my two older boys even though one is off to Job Corps and the other to college very soon. I don't meet financial requirements now :(. No assets, no savings, no credit to borrow, and no family willing to help - basically screwed.

Do you have friends that are willing to cosponsor?

Not at all.

I know it is hard. Did you exhaust your resources going to visit your husband? That can add up real quick. I see people on here who have been to see their SO 3, 4,5 times. How do they do it??

I used my tax refund, it's gone. I figure it's going to cost me $5000 for next visit (for interview) and so I have budgeted $99 a week for savings. I can't do another $4000 in the next month or so.

I'm trying REALLY hard but just can't see through this darkness right now. This is going to sound VERY sick but right now the only way it's going to happen is if my grandmother who is under 24 hour care right now passes away and has left me something. Although I pissed her off 2 years ago and she won't let it go, so I doubt I am even mentioned in her will.

OK found this: http://apps.leg.wa.gov/RCW/default.aspx?cite=26.28.010 Washington RCW's state age of majority is 18 so maybe I won't have to claim one of them, at least that's how I'll fill out the paperwork. My worry is that I claimed him on my taxes last year.

Print out that link, attach it to the I-864 with a brief note stating that your oldest son is no longer a dependent as defined by the WA state/Fed gov etc. and that your income meets the 125% threshold for a family of (#). You may even want to state that tax year 2008 was the final time he will be included in your taxes.

Also, its not necessary for you to be present at the interview. You may be able to save some money that way.

Thanks reeses, I'll do that. I am going to the interview though, everything I have read from others says it is much better for the USC to be there, besides I want to go and see everyone there and say goodbye because I doubt we will go back to Senegal. I believe after husband is here all of our trips will be to Nigeria, where his family is. He owns several plots of land there and he wishes to build us a home.

The I-864 does say any dependents under the age of 21 and dependents listed on your tax return. And since USCIS is federal, I don't know if they will even care for what the WA law says.

I'm not trying to be discouraging, just putting that out there.

Also, I like what reeses said about attaching the letter. I don't know how NVC would take it, but its worth a shot.

Actually it says:

"21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns."

It doesn't say DID not claim them as dependents so as long as I DO not claim him any longer I meet that requirement. Their wording is present and/or future tense NOT past tense. So what I did in the past doesn't matter - well at least I hope that they see it that way.
