I just read through the directions for the I-864 (have the form filled out but hadn't read the directions).

I didn't count 2 of my children because one is going to Job Corps in the next couple of months and the other is off to college soon.

What I read:

"21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns."

So now I am over $4,000 short of being eligible. I don't own anything, I don't have any savings, and NO ONE in my family would even consider being a sponsor. I also have nothing but bad credit due to my last marriage.

So terribly discouraged right now.

Fill the form out again and include the children. Especially if you claimed them ony your 2008 tax return. That is valid.

Did you claim them on your 2008 tax return?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Is age of majority 18 for Washington State??? If so then I just may be ok 'cause 1 is 18, that would mean I am $522 over the limit.

Yes I claimed them both on my taxes.

Fill the form out again and include the children. Especially if you claimed them ony your 2008 tax return. That is valid.

That's not the problem, I KNOW I can fill out the form again, it's the fact that I don't make enough and have no resources or other to help that is the problem.

You just got approved right? So, you dont have an interview date yet. Do you have an idea of how far out they are scheduling at your consulate?

Im asking if its possible that the kids will be out of the house by the time the interview comes? Will the one be at job corps and the other off to college by then?

If not and you have no other options... I would go ahead, fill it out including your children and write an accompany letter stating that each child has plans to be on their own. If your one has a letter about job corps and a date of admission, include that. If the other has an acceptance letter from the college or a scholarship letter or student loan docs(to prove you arent the one footing the bill) include that.

Im just grasping at straws here for you. Maybe someone with similar experience can come along with more help

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

You would have to show proof he is no longer in your house, and your not claiming him on your new returns.

OK RCW's state 18 is the age of majority :) so technically don't have to claim him, but since I claimed him on my taxes last year it may pose a problem.

Well, same thing goes, are you supporting them now, this year? You may be in the clear. Just have to provide evidence they are not being supported by you.
