I have been reading the FAQs for "Bringing a Parent to Live in the United States" and need some clarification.

Background Info: Parents are on Visitor's visa legally in the US.

1. Its my understanding that I need to fill-in the following forms : I-130 and I-485 for each applicant.

2. I can also file I-131(travel permit), which will allow them to travel while their petition is being adjudicated.

My question is, would the I-131 be approved prior to I-130 being approved?

How long is the I-130 and I-485 combined taking these days..The timeline shows about 6 months for I-130...

After reading the forum for more than an hour, it looks like most people petition their parents who do not live in the US.

Has anyone petitioned their parents while their parents were in the US and were successful at it?

I noticed from your profile that you are a LPR. Only US citizens can petition for parents. LPR can only petition for a spouse and unmarried children.

Am not an LPR, my spouse is.....Have you applied I-130 and I-485 for your parents?

The I-130 and the I-485 will be adjudicated together at the time of the interview. The AP will take about 90 days to be approved. Your parents will be interviewed at your local USCIS office.

As for them doing AOS from a tourist visa as long as they did not enter the US with the intent of remaining and filing for AOS they will be treated just the same as anyone else doing AOS.

Case will take 6 months+

Make sure you file both the I-130 and the AOS together and send to the Chicago Lockbox.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
