hi to all. I got here in the states 3 months ago using k-1 visa. i got married right away and had applied to adjust my status a month ago.but i haven't gotten anything from them yet. my question is how can i file a divorce??? and go back to my home country ASAP with no problem.

There is no special divorce filing procedure for those who married after having come here on a K-1 visa. As mentioned before, some states may have 'residency' requirements before you can file for divorce in that sate. I would first find out what those requirements are. You need to consult a lawyer. If you do not have money, try charities in your area that are geared towards helping low income women....they may be able to guide you in the right direction.

Alternatively, you can just leave the country and go home at any time. Let your spouse take care of getting a divorce. Your pending AOS application will become null/void when you fail to show up for the biometrics and later for the interview. Have you had biometrics yet (fingerprints)? If not, then by not showing up to that appointment you in effect signal to USCIS that you're abandoning your applicaiton to adjust status. If you've already had biometrics, but no interview notice yet....you may want to send a letter to USCIS stating that you no longer wish to pursue AOS, as some AOS petitions DO get approved without interview.

SInce your marriage is very recent I believe you can get the marriage annulled instead of a divorce. Call your consulate and get proper information for your location. PS if your husband wont pay the ticket the Consulate can help with that also if you have reason to fear for your life and or abandonment.
