hi to all. I got here in the states 3 months ago using k-1 visa. i got married right away and had applied to adjust my status a month ago.but i haven't gotten anything from them yet. my question is how can i file a divorce??? and go back to my home country ASAP with no problem.

Yes, you can divorce and go back ASAP, no problem.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

File for divorce, go home. When you do not show up for biometrics or interview your AOS will be cancelled.

HOW? CAN YOU EXPLAIN MORE INFOS PLS????

Go to a divorce lawyer, get a divorce, get a plane ticket, go back home.

The AOS will be stopped when you don't show up for the interview. Your lawyer should tell you to contact USCIS to change your status with them, and let them know about the divorce.

File for a divorce, send a letter to USCIS terminating your petition (they sometimes approve without AOS interview so better be on the safe side), buy a ticket, go home. End of story.

not necessarily...you must meet the states residency requirements before you can file in their courts. California...6 months....Nevada...6 weeks.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

that's what the "ASAP" is for, "As soon as possible".

Since I do not know where the OP is, or what laws would govern them, I used ASAP to cover that wait time. :thumbs:

You can file divorce depends on which state you are living as each state have their own residency requirement (even County have their own requirements).

K-1 [Fiance (e), non-immigrant visa]

Petitioner: Only US citizen

Actually you can return to your own country right now. Let your spouse file for divorce.

Lesson for visa filers in process: DOnt be so anxious or jealous when you see others celebrating receiving visa in hand or arriving in US with hubby. Because the day that your happy day arrives, someone here will be announcing a divorce, and will soon want to find another foreign spouse, and file for another visa. We all can feel blessed for our own circumstances and problems. Cuz someone else out there has it much harder than we do. :star:
