Oh bother! I thought I was A6 and not C9...I saw A6 was for K-1 immigrants within 90 days of arrival into the US. Would that have an effect on it? I also know that I signed and dated it, that I had copied my I-94 front and back, had a copy of my passport bio page and visa page, and that all the other info was correct (and I have an electronic copy of it).

Yes, I think you filed under the wrong eligibility. Edit your old one and have it ready to mail back same day you get the RFE (assuming that's the problem.)

Instructions below are if you filed for EAD and nothing else and paid the EAD fee. There is an eligiblity for 90 days, non-renewable. It's a worthless category. If you got EAD in 60 days, you would only have 30 more to work, then no renewal. It kinda ties in to the K1s can get a SSN in that 90 day window but not after without other proof of eligibility to stay in the US

K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--( a )( 6 ).

File your EAD application

if you are filing within 90 days from the date of entry.

This EAD cannot be renewed. Any EAD application

other than for a replacement must be based on your

pending application for adjustment under ( c )( 9 ).

I'm fairly certain that we're over the poverty line (for a household of 3 people since we're including the co-sponsor's income) so we won't need to present the evidence outside of the income. That's what I wanted to hear.

I really hope there's no problem with getting the NOA1 outside of my 90 days. As long as we married before, that's all that counts, right? We'll literally be a few days over for the AOS.

Sorry to hear about your RFE, Magpie. I made the same mistake that you did too, reading down until I saw the K1 section. My husband (that still feels weird) was the one who pointed out the AOS section, and then I saw that it's the right one if you're filing together. It was pretty confusing though. Hopefully you can get that filled out and ready to go!

Thankums, Nich...I do feel a bit of a duffer about it. I hate sitting on my hands and waiting, and it was the employment authorization that I really didn't want delayed. Blaaaaaaaaah.

Hey guys - 2 quick questions:

1. Anyone had any recent experience of applying for Driving License in New Jersey?? I am looking to get an examination permit and sit the written test as I only have a provisional license from the UK. Do I have to wait for my EAD? I have read conflicting messages, I called up the MVC and they said I was fine but i'm not so sure and don't want a watsed trip to the test centre in Wayne NJ. sorry if I missed the answer somewhere.

2. I lived in the US previously in 2006 for a year on a J1 Visa, I was working as an Intern, paying taxes etc and was issued a Social Security Card. On this card it says "valid for work only with DHS authorization". My understanding is that my SSN does NOT change and I do not have to apply for a new card.

Right that the number doesn't change, wrong that you don't have to apply for a new card. The card you have will be just fine until you are approved, and have received your green card. One you have the GC in hand, you apply for a new SSN card, minus the restriction text. Funniliy enough, I've just completed that process myself, and received the card in the mail yesterday.

Make sure you do this - I've read of more than one VJer that didn't, and has run into issues down the line.

Now been 10 days since the NOAs and still no sign of the Biometrics letter. Our case status currently says:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Fingerprint fee accepted; receipt notice mailed and case pending.

This statement was dated 1st September but our last "touch" was made on the 4th, are we right to expect our Biometrics letter any day soon?

Thanks Nich, your hindsight saved me from sending things in with an A6. This AOS paperwork is way more difficult then getting Pat's K1. On the other side it's a lot easier with Pat here as my wife.

On the plus side we got her SSN (alas stamped not vaild for work). However, we can start getting her added to my bank accounts, get her driver's license, etc.

Social Security number: Yes, use the old number. It's yours for life. Get the restriction wording removed after getting the GC just so you have a nice clean card I guess. You could change to your married name too. Actually Americans don't show their SS card much except maybe at the driver's license place for their first license. Many forms, banks, credit card companies, tax returns ask for you number but you just tell them without physically showing a card. I bet half of America doesn't even know where their card is. Memorize the number and put the card away, then forget where it is in 10 years like the rest of Americans.

Also a tip to the new immigrants....don't give out that SSN except for authorized reasons. It's the key to your whole US identity, so protect yourself from identity theft by not carrying the card and not giving out the number to phishing schemes.

Okay kids. I found some info on the SSA website....official stuff not VJ talk. Just going to summarize some things about the "change in restrictive legend" as they call it. You can go to www.ssa.gov and search that term and find references. Lot's of good plain talk explantion in the summaries of congressional reports by various SSA officials.

Fact part: As far as SSA records go, you are recorded as you first applied (probably as not authorized to work.) If you update your name or work status, by showing appropriate proof, then they change their SSA records on you. If/when you start a job, your wages are reported to SSA because some of your wages are withheld to pay into Social Security. If the SSA records indicate you are not authorized to work, they report to the DHS (USCIS) that wages have been paid on that SSN (that they have on record as not authorized to work.)

Opinion part: If your wages were reported to DHS (USCIS), they would surely be able to see that they had indeed authorized you to work so wouldn't come after you. SSA's job is merely to report descrepancies. So by updating SSAs records, you save them from reporting your wages as a person not authorized to work (as far as they have knowledge.) Also I think updating records with only an EAD card is an intermediate step not worth taking. It would get you a new card without the "restrictive legend" but since it's good for only 1 year, after that year was up then they would think your work authorization was expired as far as their records show. The green card will follow so quickly that I would wait for it before going to SSA. I also learned that what the card says is not what's important, it's what their records show. As a matter of fact, you are not required to show an actual SS card to an employer....it is even against immigration law for them to ask you to show it. You write your number on their application and it's their job to verify that that number is valid in your name and authorized to work. There are too many fraudulent cards for the card itself to carry much weight. Houston flea markets are notorious for selling fake SS cards. Work authorization MUST be verifed by means other than seeing a card. This wasn't true in the past, but changes have been made through the years to better verify who can work and who can't. E-verify is the latest way, but not all employer's participate yet.
