Hannah, what was explained to Sarah (bare in mind this is for Ohio, not California) is that she can get her Driver's License but it will expire date of the EAD (so like June for us). They told her once she gets her Green Card in hand, that she can go into the BMV and they can switch it over to a full license.

Dunno if the rules are the same in CA, but that's what we were told for Ohio!

I believe it's similar here but what I was worried about is how long is ead good for and if they take the ead at the interview does that void the ead early and then also the licence? In short does one have to go update their dl the minute they get the gc? Or can you wait a few weeks as long as it is before the original expiry date of ead?

Hannah--

Driver's license and EAD aren't exactly dependent. CA does want to make sure you have a certain length of time legally in the US so they don't give you a license to use as ID well beyond your legal allowed time in the US. Once you get a license, just use it until it expires if you wish. They don't go back and check your immigration status and if your EAD card got taken at an interview. One office is the State of California and the other is the US government so they aren't that tied in to one another. EAD is good for a year so a DL should be good for that long. After green card, they might give you a license that lasts longer, but you might have to pay again. Have you talked to anybody at the DL office or read their website to see what CA rules are? That's the best thing to do since each state can be totally different. Ring them up and ask all the questions you want straight to the local office that you will get your DL from.

Miss G--

If you get married in Guatemala, your husband won't be allow to enter the US again on that K1 visa after the wedding. The only way you can get AP (I think) is to have already married and filed for AOS. Its a document that says he has AOS processing and he can come and go without a visa until a decision is made on his AOS. There's many stories of K1s who left the US on their honeymoon and the non USC was not allowed entry back into the US. So they had to fly back to their home country and start all over with a K3 married visa to come back to the US.

You can make multiple trips on AP. They send you two. You can turn in a photocopy at POE and keep the original to photocopy and turn in the next trip.

Yip. You can travel within the US but not outside it (and if not for this, I wouldn't have been able to fly down to Texas). That can only happen with the shiny AP document (advanced parole/travel doc I-131) you apply for with your AOS stuffs. I was looking stuff up because I was wondering if I could go on a road trip (Knight's family has had a colourful past of driving through various parts of the West Coast), but all roads out of Alaska go right through Canuckia (oops, Canada). In order to go into Canada, I have to be the proud holder of a green card or have the advanced parole document. That document also asks if you're going to make one trip or multiple trips, and you have to justify it one way or another -- or just use the helpful letter format Nich has wonderfully provided.

The drawback to having a one-trip and driving through Canada is that I'd have to drive back through Canada, and will probably be denied entry to the US (or somesuch). This means that I'll be flying, if I do fly anywere in the US, and I'll have to avoid road trips until I have my shiny green card in hand.

So Miss G, looks like you'll have to get married in the US, but there's always the Riverwalk in San Antonio (TX)...

Oh! Also, Miss G is the immigrant :D hubby-to-be is a US citizen (I think).

Miao!

I know its a bit of a stupid question, but i was reading the requirements for AOS, where do we get certified copies of stuff, is it like in the UK where you go to the notary public, banks lawyers etc... to get certified/notified copies?? would we have to go to say the secretary of state?

If memory serves correctly, the only thing you send wiith your AOS that needs to be certified is your marriage certificate. We got ours from the courthouse of the local county in which we got married. Cost about $15, I think.
