Nich is back. I've been wheeling and dealing this morning thinking about buying a house.

Nothing has to be notarized or notarised. 100% sure. Final answer.

The Form I-864 and Form I-864A, however, provide that they are signed “under penalty of perjury.” Thus, 28 U.S.C. 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

From an "everything you could want to know about the I-864" memorandum. (p.4 of 27 pages, which I have read in entirety.)

http://www.uscis.gov/files/pressrelease/AffSuppAFM062706.pdf

Thank you!

Damian, As far as I know, nothing needs to be Notarised. (Hopefully Nich will answer to be 100% sure)

That's what I thought, but I just want to be sure. And yes, I'm waiting for Nich to respond too!

Nothing needed to be notarised last April when I sent mine off, and as far as I'm aware that hasn't changed.

And thank you.

Also, we got our NOA's last week for the I-485 and I-765 (we didn't apply for I-131). Still waiting for Biometrics.

question: why did you decide not to apply for I-131 (AP)? i was operating under the assumption that the hugely expensive $1010 fee covered: I-485 (AOS) @ $930 and the biometrics @ $80. additionally, if you filed I-765 (EAD) and I-131 (AP) concurrently with the AOS (or if you filed for them later, but provided documentation of payment and a I-797C (NOA)), these fees were waived.

we have no need for the AP papers...my wife's pregnant and we have no need to be leaving the country until after the green card comes through, so there really wasn't a point in getting it for us. But that's just us. She isn't planning on working once the baby was born, so the EAD may not even be used...it's just a matter or our prerogative :)

I was of a similar mind to you, but then I had a thought: what if a close relative was seriosuly injured, or God forbid, died? And I mean somebody you loved dearly? You'd have to go then, right? And the last thing you would need after such a loss is grief getting back stateside.

That's why I applied for it anyway.

My AOS has been approved, well, I assume it has! I have suffered one those USCIS twilight zone events (The music is in my head right now!).

Today I checked my email and noticed I had one from the CRIS, quickly I opened it up to read, my excitement quickly turned to despair, NOOOOOOOOOOOOOOOOOOOOOOOO!!!!!!! The email stated that the greencard was undeliverable and as such had been returned to USCIS. It went on to say that I needed to contact USCIS and change my address!

All of this would be okay if it were not for the fact that I changed my address back in February, received notification stating I had done so and received my EAD card at my new address! So confused is putting it lightly, dumb founded more like, LOL!

So, any way I go ahead and call USCIS, I speak to this nice lady and mention that I have already changed my address. She tells me that there is a change address form on the system but, wait for it!, I had forgotten to add my new address! At this point I was becoming even more confused??????? I replied 'Well, if thats the case why did I receive a letter confirming my change of address for the I-485, I-765 , and I have since received my EAD card at my new address?????'. To which she said nothing, she was very confused too! Well to cut a long story short she took my address and said 'I am really sorry for all this, you should receive your greencard in the next 5-days, o.k'. I must mention that she was very polite and seemed amazed that this had happened!

The good news from all this is that I have got through the AOS barrier and am free, for a while longer at least!

Congratulations to everyone else who has received good news recently!

Good luck to everyone still waiting, I hope you hear something soon!

If you have a real emergency I believe you can go straight through your local office to have AP granted almost immediately. Therefore I did as some of you have done and did not file for AP as I'm not planning on making any trips out of the US before I get my greencard - saved me some paperwork!!

What this means is that your case has been transfered to CSC, and that in turn means that you probably won't have to go through an interview. That's what most of us are hoping for!!!
