RFE issued December 31. We figure it can be a couple of things.. not enough pictures, no original marriage license (we sent a photocopy) or the medical form. We were expecting to get it for something, since it's kind of a frazzled time to be filing paperwork (right after getting your fiance visa finally and getting married).

I'll be interested to see what they want.

Happy New Year Ya'll. :jest:

I talked to Stinky Monkey (Shaz) this afternoon. She's still in London and has been quite ill with her back problems. She spent a month in the hospital flat on her back, but didn't have surgery....just morphine, other meds, bed rest, etc. She's home at her Mum's for now and isn't sure when she will be released to travel.

Ohhh :( I hope that she gets better soon. I'm glad you managed to get in touch...did you manage to get the number from someone? I'm so sorry that I couldn't get it to you, I wish I had written it down somewhere. Hopefully she's had a decent Christmas and new year's...

Speaking of which, happy 2010, everyone :D. May it be wonderful for everyone!

Snowbunnies, didja ask for an official copy of the marriage certificate? I asked for two additional copies as well as the original, so I had two to hold onto and one that I could send to them. I guess you'll be finding out soon enough @_@ we got an RFE too, and it's nailbiting not knowing what it's for. In our case, it was very minor, so I'm sure it'll be the same for you guys :D.

Yes, we have 2 official copies, but I figured since they never seemed to want original paperwork in the 129F packet, the same would apply this time.

Hopefully, we'll get our letter next week sometime. I hate being in suspense. :)

Sorry about the RFE S'bunnies. It seems like there are dozens and dozens of people getting I-693 medical RFEs all of the sudden. And it seems most were November filers. Not sure if anybody has gotten some official word yet, but the threads indicated most were puzzled as to what to do. The RFE was vague (as usual) saying something like "please submit a properly completed I-693." So people just didn't know what that meant for them to do. And it happened to people who had just sent in the DS-3025 AND also to people who had sent in the civil surgeon (signed and sealed) completed I-693 (which should have been a "properly completed I-693". It's been very widespread and hitting people that have done everything exactly right. So it's very frustrating not knowing what the heck generated these RFEs and how to answer them. I haven't read if anybody actually got to talk to a USCIS person who could explain why the sudden bunch of RFEs for K1s.

Wonder if this has anything to do with it all, maybe some of the USCIS staff got confused :(

USCIS to Hold Certain Cases Pending Changes to Vaccination Requirements

November 28th, 2009 WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) has, since Nov. 13, 2009, temporarily held certain applications to adjust status to lawful permanent residence until new CDC vaccination criteria become effective on Dec. 14, 2009.

The Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC) announced on Nov. 13, 2009 new criteria for determining which vaccinations will be required for applicants seeking to become lawful permanent residents. Based on these new criteria, and beginning on Dec. 14, 2009, the vaccines for herpes zoster (zoster) and human papillomavirus (HPV) will no longer be required for immigration purposes.

As a result, since Nov. 13, 2009, USCIS has held any application that would have been denied solely based on the applicant’s failure to show proof of having received the HPV or zoster vaccine. USCIS will resume adjudicating these applications on Dec. 14, 2009, using the new vaccination criteria, which eliminate the need for the HPV and zoster vaccines.

More information on the new criteria and changes to the vaccination requirements is available on CDC’s website at CDC Information on Vaccination Requirements.

I was wondering if somebody was new and got confused and was rejecting those that didn't have the whole medical filled out. There's alot of adjustment cases that do complete the medical because they've been in the US for years under other visas and didn't get a recent medical in another country. It makes you think somebody didn't get the memo that vaccination is all K visas submit. That new thing you posted is because they dropped the HPV and zoster requirements. I think the intent was if somebody applied in November and didn't get HPV, they would just hold the case until Dec. 14, when their case would pass without HPV. What a bummer that so many of this years adjustment people had to get that expensive HPV when they didn't really want it. Now it's a thing of the past. Unlucky timing.

Hi Everyone hope you all had great holiday seasons and 2010 is looking good for you all.

So now I must get to grips with our VJ and I am trying to mail all my forms.

I have some questions that I hope someone maybe able to help me with?

I appreciate all the support I have had in the past from you all. I am sure when I mail this whole packet I will need help to update my timeline and things like that too!

1.Do I mail everything in the same envelope I-130 and I-485? What address do I mail to?

2. Do I include proof on Bona Fide Marriage with these forms or take to interview only?

3. What do you suggest I include if I need send with forms?

4. Form I-765 question 16 what is the correct answer to go in the brackets?

5. Where it asks for A number I leave this blank?

I am basically applying for AOS for my husband we married in June and he is here in the USA with me?

Posted (edited)

I'm glad Shaz is OK... ouch, though! I hope she managed to have somewhat of a good holiday since coming out of the hospital.

Happy New Year, everyone!

I had a huge meltdown the other night because of all the stress of trying to build a new life whilst being stuck in the suburbs with the in-laws and without travel. I felt like I was in a rut and feeling lost. Me and the husband had a big talk and decided that this is a new beginning, so a new attitude is needed. I'm going to push hard to rework my resume, search for a suitable job and get myself out there in the professional world; also re-study the driving manual and take the written test before I forget it again, and lastly; do what is best for ME and my future over here. I've been hearing from everyone how I should be doing this or that, and I've been trying to keep everyone happy with me (promising a trip to the UK when it isn't financially feasible, applying to jobs that I'm not happy with, meeting with people that bring me down), but this is my life and if I want a future over here, I need to do what's best for me. I have full support from my husband, and this is the year we're going to make a proper life for us. No immigration issues and no family issues in the way. I guess that's my new years resolution, to make myself a life in the US.

1.Do I mail everything in the same envelope I-130 and I-485? What address do I mail to?

Yes, you send the I-485 (AOS form), the I-130 (travel form) and also the employment form if you want the EAD - along with all of the financial evidence, marriage certificate, etc to the Chicago lock box (I had trouble finding the address too, just do a search). There is a complete list of things to include on page 6 of this topic.

2. Do I include proof on Bona Fide Marriage with these forms or take to interview only?

Just the marriage certificate for proof of marriage. If you're called for an interview, you can then start thinking about taking evidence such as joint accounts and whatnot.

4. Form I-765 question 16 what is the correct answer to go in the brackets?

What's the question? Is this the one where it asks what your adjustment code is or something along those lines? I think it was C6 (for adjusting from a K1 visa), but please don't take my word for it until you get conformation from someone else.

5. Where it asks for A number I leave this blank?

You should have an alien number on your K1 visa.

Good luck!

This is the question that needs codes.

Gemmie, I'm glad that you're doing what's best for you. As much people in the UK want to see you, your focus is you and your hubby right now, as well as settling into the US. It's a massive transition that you've undergone, and a great deal needs to be done before you do things for other people. I completely understand that. With the job, just remember though that even if it's not one you want, it doesn't have to be forever. It'll at least bring a little income in until you find something better. Before I got the job with the federal credit union, I had prepared myself to work at Sears for however long it took to move to something else.

:D Focussing on you is the best thing you can do right now. If you need any thoughts on your resume, do shoot me a private message -- I had received lots and lots of great advice from peeps about mine. I have a feeling that reworking it ended up getting me the interview I desperately needed, and I think that's what ultimately sold me in the end. I can give you my email address :D.

Hugs!

Song41---before we confuse you, almost all of us here are from K1 visas. It seems like if you are sending the I-130, then you must NOT be adjusting status from a K1 or K3. Is he adjusting from another visa or did he just come, get married, and stayed? Your process is different and I've never studied it. Your questions could probably better be answered in the forum Adjustment of Status from Work, Student, and Tourist Visas.

Just guessing, cause I haven't read about it, I think you probably send some kind of relationship evidence with the I-130 just like we submitted with evidence with the I-129F. And I think your question about the Employment Authorization form is based on your pending application for adjustment of status, so your category is ( C ) ( 9 ).

This is the VJ Guide for married people both already in the US.

Yeah, definitely. I can see where they're coming from as my brother has a baby now, and he keeps moaning that I haven't seen him yet, and telling me every time he does something new, that I need to see him. I tried to make everyone happy by saying if I didn't have any jobs lined up by the end of January, then I would book a ticket, but honestly even then, I'm not comfortable with that because we're still trying to save money, and I'm still trying to find myself a life here. It might sound weird, but I didn't really want to go back and see my "old" life without having a new one established here. I just find it hard to say to my family "I want my own life first" because it sounds selfish. I don't want it to look like I don't care about my new nephew.

About the job, one thing I do know is that I really didn't want to end up working in retail. I've dipped in and out of that in the past, and it was an area I really hated. Perhaps I can find a similar job to yours, or in admin.

Thanks so much, Magpie, I would love your email addy so I can send you a copy. ANY advice would be greatly appreciated. :D

Nich, I had wondered at first if he was adjusting from another visa than the K1 when I saw the I-130, but then wondered if I was having a brain spasm, and the I-130 was actually the AP. My bad.

Congratulations on a great attitude and resolution for 2010! It took me decades to figure out that I really need to do the things that make me happy too. You are soooo ahead of me in figuring that out. :star::star: Gold stars for your maturity. You will definitely make it with that attitude.
