Tax Return Question

This addresses certified or notarized tax returns. It's for the I-864, but could be interpreted to be applicable to any tax return submitted for Affidavit of Support purposes since the I-864 is more rigorous than the I-134.

Affidavits of Support on Behalf of Immigrants [ 71 FR 35732 ] [FR 23-06]

DOCUMENT NUMBER: FR 23-06

FEDERAL REGISTER CITE: 71 FR 35732

DATE OF PUBLICATION: June 21, 2006

Income Tax Returns

Section 213A requires the submission of certified copies, but the interim rule and the Form I-864 itself make it clear that, by signing the Form I-864, the sponsor certifies under penalty of perjury that the copies are true copies. The final rule does give the sponsor, substitute sponsor, joint sponsor, household member, or intending immigrant the option of submitting either photocopies or IRS-generated transcripts of the required tax returns. Along with the transcripts or photocopies, the sponsor, joint sponsor, or household member must submit copies of all Forms W-2, Forms 1099, and schedules, as specified in the rule.

That is saying that at one time certified copies were required, but a rule changed that and by signing the Affidavit, you are certifying that you are submitting true copies of the tax return.

Does that help convince anyone that tax returns don't have to be notarized?

I dont need convincing !!!!!!!

Sorry :( When I've seen questions about notarization for the tax things, I have only seen questions regarding notarization of the i-134, not the tax returns! And I didn't know that since copies are accepted, it means you don't have to get them notarized..sorry :(

Don't be sorry! I freaked out at least 100 times while preparing the documents for my fiance's interview. Even now after I have sent all the papers (I made and remade the list of papers to send about 100 times as well) I sometimes find myself doubting that I should have sent more information...but then I remember that we have more than enough.

We are all here to help!

Visa Journey completed, but we are still here to provide support! :)
