Need help!!! my wife received a white paper

Andy these reasons are very easy to overcome. First you should have been there for the interview however thats water under the bridge now just make sure your there for the next interview.

I would make 2 more visits first I would take several more pictures. I made the mistake and only took pictures the first week I was there. I would also go back for the interview. It sounds like they were fishing for some reasons to deny you possible because of the visit.

My fiance at the time now my wife was denied and they said I last visit her in december of 2007, her interview was nov 6th 2008. They interviewed her for about 20 minutes they even asked where my brothers lived and worked she got it correct however they said she didn't know where I worked but she did she even repeated it twice. They were just fishing for wrong anwsers and when they couldn't find any they made something up because she awnsered them in a quite voice twice so they pretended like they didn't hear it. They cannot deny soley on visiting frequency.

I would hire a good attorny appeal the denied petition and when the attorny tells you to file agian go for it. It just sounds like you were not very prepared however you can learn from that and it will help you next time.

If they didn't send the case back you need to contact your congressman asap and get them to stop from sending it back if no luck there then contact a good attorny that can stop it

my file is close at the embassy and it's on the way back to uscis. my questions is can i refile i-130 or i need to appeal first. i heard appeal will take up to two years. That's just crazy waiting time. Have u hear anyone refile and pass the interview the second time???? thanks

Yes there are many members on here who have filed a second time and recived the visa the second time. Denials are not that hard to overcome

have you guy heard anyone appeal when they received the white slip???? I am thinking doing both, refile i-130 and appeal the case once i get it. which will be 4-6 months from now. I dont know if u get do both.this is my first marriage, we didn't prepare for the interview which cost us all this suffering.

Yes, it will take a while to apeal USCIS. If I was you, I'll start a new petition instead of waiting (My friend was the same your situation, his wife is now waiting for an interivew. Failed K1 and refiled K3). I'm not sure if K3 requires a WAIVER, OR need to drop your old case inorder start new one.

Even if you file a new K3, you and your wife must work hard on your relationship, also she must well understand your life, family, jobs, hobbies, relatives...etc, otherwise, CO will nail you down again. Base on the denied notes.

I'm not sure if she was neverous at the interview or not, but I can see a big gap between you two, about "Jobs, personal history, family". With those things, CO could 'hunt' you down.

About "photos", when you're two spend time together, make sure take a lot of pictures, ALSO do NOT wear the same shirt that you've already worn. In fact, did you two take a lot of pictures?. About "visit", someone over here will details on this one. In my case, I made 3 trips in 2 years, even 1 of those only 10 days.

My point is, just try to analyse the problems, so you can see it. If I wasn't know this website, my fiance might still stuck somewhere in Vietnam or I have to pay money for Attorney.

My fiance was denied the first time because lack of bonafide relationship. I was only with her a short time and only had a couple photos. They were correct in denying us as we didn't know much about each other. Second time [different lady] I made multiple trips and had LOTS of pictures.

Another reason the first one was denied was she didn't speak English well at all and her answers were misinterpreted. If your lady doesn't speak good English get her lessons for the second time.

Bryron4 reported earlier that was one reason his lady had problems at the interview also.

hey Haole so u did refile i-130 again? did u have any trouble when u refile? and how long did it took u? did u try to appeal? thanks

If they have been married for almost two years then she should know the answers to the questions. If the last time they were face to face was October of 2007 then you will have to make a trip there again to show USCIS that you are trying to be a married couple.

Seems that the interview was bad and the lack of time together was another sign to the CO that the relationship is questionable.

OP needs to spend some time with his wife to demonstrate a bona fide relationship. During that time together make sure that the spouse knows all the things that a spouse would typically know about their mate.

i am planning to go back in Sept and try to have a kid together. But right now i dont know what should i do, wait for the appeal or refilei-130 and start the whole nightmare over.

As my experience learning from several forums, you should appeal right away to make them know that your marriage is true. At the same time, you can refile I-130 coz it takes several months for USCIS to receive your case back. You can ask for help from your senator to make the case sent back quickier. Here is the forum which I see as very useful. You and your wife can get real experience sharing from people there.
