Could they be waiting for an I-129???

Ok, I know it's entirely too early to worry but with so many quick I-130 approvals at CSC, I am getting a little worried. I did write "K-3 Visa" on the purpose section of the I-130 and now I'm wondering if they could be holding back our I-130 thinking I'll send an I-129. I decided to go with the CR-1 after reading a lot on this board and was told it wouldn't matter but then I'm seeing that I-130s and I-129s are getting approved together, usually on the same day. Do you think they might do that...hold an I-130 back waiting to get an I-129? If so, what should I do?

07 April 2009 - RFE (Divorce Decree)

15 April 2009 - Re-submitted divorce decree

I would not worry about it, will not effect them processing what you already sent them. Cause most of time when a K3 is filed, they USCIS have been processing ither the I-130 or the I-129F. Dont worry about it. You will be approved just on your I-130 petition.

Well, I'm not so sure that the I-130s and I-129s get processed separately, if I understand you correctly. Looking at a lot of the timelines in the K-3 forum compared to here, it seems the K-3 (I-129 & I-130 together) process is taking longer at USCIS than only the I-130 by itself. The fact that most I-130s and I-129 are getting approved on the same day lately can't be a coincidence. Just seems that they're putting the two together and processing at the same time to save work. If that's the case, it would make sense for them to hold back any I-130 petition that shows K-3 as purpose...so they'd wait for an I-129 in order to do both of them at the same time. Again, I'm probably just worried for nothing but don't want to lose any time for a stupid little detail like that. Does anyone know for sure? Has anyone done the same thing I did...write K-3 on the I-130 but didn't send an I-129?

I'm looking at my Form I130, I don't see any space there that asks whether I'm filing for K3 or CR1. Could it be that you've mistaken the DS 325a to I-130? I've seen the space in the DS 325a where it asked about which form you're filing it for.

just wondering coz u got me scared. hehe. we've recently decided to drop the k3 visa too.

You're right...I just checked too...it's not on the I-130 but on the G-325s, duh! I also wrote K-3 on the petition cover letter. Since those went in with the I-130...I'm scared it went into a different "pile" as other I-130s. God, I hope not!

The only time USCIS knows a filer is filing truly for a K3 is when the I-129F is received, other wise they will process it alone just the I-130 petition. Filing for a K3 only slows down the process, once they receive the I-129F , its paired with the I-130 and ususally the whole petition goes to bottom of the pile. Dont worry, they will just process I-130 when its next in line and your petition is on the top of the stack it will be processed. They wont hold it back cause you wrote K3 on it. You'll see, its going to be just fine. Best wishes for a quick journey.

don't worry - we been waiting since 03 nov 08, see me timelines....you only need I 130 if yur married already.

its a damn long wait for some of us - and not so long for some...

waiting waiting and waiting!!!!!
