i wanna know if i have 45 days until my visa expires or if i have 45 days until my I-94 expires to file for my visa extension. I want to know this because I have file for AOS on a K-3 visa. My visa expires before my I-94. My Visa expires on May, 16 and my I-94 is on July 10. :unsure:

You file for an extension of the K-3 visa before it expires ONLY if you wish to travel out of the country while I-485 is in process.

K-3 does NOT file an I-131 for an AP doc, the K-3 allows travel and re-entry while AOS is processing.

The I-94 can expire but it is recommended to file I-485 while the I-94 is still valid.

NOTE: if your visa medical was more that a year before you file the I-485, then you will need to visit a US Civil surgeon and get a FULL medical done on an I-693

Thank you very much :) but one more question, can i renew my EAD eventho my visa is going to expire in 45 days?. My EAD will expire on July 9th.

If you are not going to extend your K3 then you will file for a new EAD along with your AOS.

Correct, EAD based on a pending I-485 costs nothing. Renewing your existing EAD before filing AOS will cost you $340 more.

File I-765 along with the I-485, and code the I-765 (C )(9 ) based on pending I-485.

aaak! can I still send it eventho I already sent my I-485? I sent my I-485 last January. :unsure: Thanks so much for the replies. :)
