Just talked to USCIS ~ for all K1 visa Applications~

Timeline

HI all! I had some low times at work earlier, I called the USCIS to ask why my case is still showing PENDING when the NOA 2 was received on 3/20. Then I asked a question of WHY my case has not yet arrived at NVC. The operation from USCIS said, that all K1 Visa Cases will NOT BE GOING THROUGH the National Visa Center. She said, according to her notes, that our case will be directly transfered to the country embassy consulate. My fiance would be receiving his packet # 3 !

So,this makes me so confused. Afterall, we WILL NOT be receiving a NVC case # at all. This will be directly going to the embassey consulate...

So, NVC... not a player in this journey ??

Anyhow have any comments ?

Why don't you guys try calling USCIS with your receipt number and talk to an operator....and see what they say ?

I'm like super super confused now !!! its different from everything else i'm hearing ~~

NVC is the gateway to the consular system... "K" files typically spend little if any time at NVC, but they still must go through the gateway

That doesn't sound right at all. Your first mistake was calling USCIS at all. I learned that the hard way.

sure it is being forwarded to the consulate... it does not indicate the process of getting there which includes going FIRST to NVC

My understanding is that the NVC is the "forwarding agency". So yes it is sent directly to the embassy (but by magic it is the NVC that does the forwarding).

So both told the truth and both did not know the "rest of the story".

I've read that the NVC does its own set of processing/checks/whatever and there have been cases where the application has remained at the NVC for quite a long time. If that is true, then the NVC is more than a forwarding agency. Can anyone confirm this?

I called the NVC about a week later, and they said they had already received and forwarded it to London.

So... yes to the NVC :)

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

This is definitely correct. Any case can get hung up at NVC but it's rare for K visa cases.

We don't call it the misinformation line for nothing.

Now, if you want the case number NVC assigns, you must get it from a human, not he automated system.

Just got my NOA2 letter and mine states "The above petition has been approved. We have sent the original visa petition to the NVC... USCIS has completed all action; further inquiries should be directed to the NVC. The NVC now processes all approved finance(e) petitions..." So apparently mine is going through NVC. Maybe it's different for those with prior I-129F approvals.

2/10/09 received

2/12/09 NOA1 issued

3/27/09 NOA2 issued

4/9/09 received @ NVC

4/13/09 sent to US embassy

4/19/09 received @ embassy in Seoul

You called the mis-information hotline. My wife just drove off to class in her car, with her driver's lisence and green card in her wallet, and our case is still listed as "received and pending"
