my case is a lil bit complicated, so im gonna make it short, i just moved back to france in december to apply for the k1...

so as of now , i am unemployed(i wasn t when i lived in the us) i do have a new job waiting in the us...but im just scared of when they re gonna ask , what do you do and i have to reply...o nuttttttin right now just chillin...should i get a letter of my future employer? would that be enough?

Okay, I'm a bit confused! Sorry! Your signature and status says that you are applying for a K-1 visa. Who are you? When you say *you* just moved back to France, we need to know who *you* are. Are you the American or the French person? I remember from earlier posts of yours that *you* are the French girl...but is that still the case or is this a post from the American boy?

Sorry if I am missing something here that would explain my questions. If you are the American and you are saying that you just moved back to France and therefore do not have a job -AND APPLIED FOR THE K-1 VISA- then as long as you have a co-sponsor in the US, then you will be fine. I (the USC) was living in London when I petitioned my fiance and used my parents as co-sponsors. I did not have a job waiting for me in the US and they did not care. As long as you have a co-sponsor, then you are all good. If you are not the American, then it doesn't matter either way. The US consulate only wants to know that SOMEONE (american) will support the non US citizen if they ever need government assistence and they do not care at all if the Non US citizen works or not. I repeat, the Non US citizen DOES NOT need to have any job, ever, anywhere. They don't care about that AT ALL!

Also...this is the DCF forum (direct consular filing). If you are applying for a K-1 visa, then you should post your questions there. However, if -since you say you have just moved back to France and you ARE THE US CITIZEN- and you are thinking about applying DCF INSTEAD of K-1, then we have a totally different matter on our hands.

Clarify what is going on and maybe I and others can be more help!

Are you the USC petitioner? If so, it doesn't matter if you live in France (you must have a US address for delivery of documents) bt how will you prsent an affadavit of support? A job waiting in the wings won't do it. If you have the support requirement covered (co-sponsor or lots of assets) then don't worry. They will not only "ask" you will be required to prove you have sufficeint assets and/or income to support both you and your fiancee.

If you are the foreign fiance petitioner your employement situation, before, now or in the future is not a factor.

OK, now I understand. No. No one in the process is concerned about your employment status. As long as the USC petitioner has means to support you, you are fine. I wouldn't mention anything about a job and I doubt you would be asked. If you are, say "Yes, I plan to work after proper authorization"

If you were already here on a work visa i'm quite sure they would consider the fact that you have a job waiting for you perfectly acceptable.

Like the others have stated, your work status has little bearing on your visa eligibility, however...the CO may take the fact that you have a job waiting into consideration if your fiance's finances are borderline. Each Embassy interprets the criteria for financial status differently.

The I-134 is used only to help support the idea that the alien fiance will not become a public charge once in the US.

Some Embassies can be very strict in their interpretation of the 'rules' but in NZ, for example, they cared very little about the I-134 and more about the fact that my then fiance had a great education, work history and desire to work in the US.

It's most important you know how the Embassy you're dealing with works. See the Embassy Reviews and Info links above for more on that.

They dont care if you work or not and they definately dont care how much $ or savings you have, they only care how much the petitioner earns and if he is employed .... Im not working atm either and when I filled in the papers for pack 3 when I got to those sections I put down Volunteer Receptionist as I was volunteering at a Salvation Army Relief centre at the time (actually yesterday was my final day) ... I proceeded to fill in the address phone number etc as if I was employed .... I wasnt sure what to put but I figured that a voluntery position was not any less important just because money wasnt exchanged and it didnt seem to make any difference infact it was never mentioned ... at my interview I was asked what I intended to do when I went to the states, I said start a family but at that stage you could say you would like to return to your previous line of work as a (whatever) when you have your proper work authority ... but keep in mind that can take a little while to come thru...

Today is the Tomorrow, you worried about Yesterday .....

If u wish to show ability to cover yourself financially rather than having your spouse do so (e.g. by submitting an I-134), then YES, get a letter from your employer stating intention to employ ASAP you upon your return to the USA.

If you enter via JFK, I understand you can get a stamp on your visa that allows you to start working immediately. otherwise, there will be an ~3 month gap as you apply for work authorization. Regardless, however, the USCIS instructions clearly state that proving you having a job lined-up for when u enter is acceptable proof of financial viability.

The JFK stamp will be going away shortly as they have revised the I-9 requirments. Last I heard it would be defunct as of April 1, and I heard unconfirmed reports it was extended until June, but I cannot say for sure, at any rate, it will be passe by the time she arrives.
