Hi guys!

I am in a dilemma and since all of you have been so supportive I could really use your opinions at this time. This is regarding my RFE as it requires me to get a document from abroad. My attorney wants to provide some other evidence because it may take a long time to provide what they actually need. I want to provide USCIS exactly what they need rather than taking risk. She is telling me that the other evidence will be suffice and I will not get a denial. Do you think I should provide what USCIS wants or listen to my attorney? I will be able to get the document, but I am not sure how soon it will arrive from India. I am so close to getting my approval. Any advice would be appreciated. I am going insane regarding this, because a denial would mean to start all over and I am so close. I don't want to screw it up now.

I am sorry your RFE is causing so much trouble.

Given I don't know what exactly USCIS asked for and what your attorney suggests, I would try to get exactly what USCIS wants. You don't want to wait because you want the approval faster? Or, you are afraid you may not get things from India before RFE's deadline? I think you should be able to call USCIS and ask for extension. If it's not possible, I would prepare what your attorney suggests just in case (and don't send it for now). At the same time, have your fiance send the document you need. Then, when it's just enough time before RFE deadline to send things to USCIS -- I guess couple of days if sending next day delivery -- you send either the required document or what attorney suggested.

Thanks that is a good plan, and yes you are right I should go for what USCIS asks for exactly and use the attorney's suggestion as a last resort. I guess this is just another obstacle I have to face. I tried calling USCIS, but they pretty much said no for an extension. But, I will wait and submit the other evidence if I don't get the correct document I need from India.

??? The RFE asks for something (what is it?) and your lawyer says to give them something else (what is that?)? Give the USCIS what they want. All of us have to do this. I would also find another lawyer or consultant.

This is my divorce decree from India. I got divorced in India and an islamic divorce is considered legal in India. I submitted an affidavit from my ex's family signed my 3 witnesses stating that we are divorced per islamic law. This even states that on the dept of state website that per islamic religion and customs divorced do not need to be registered through civil authorities.

To get the final divorce decree may take more time required than the expiration date on the RFE. But, I am legally divorced per Indian law and I don't know why they still want additional evidence.

My RFE states:

Please submit a copy of legible divorce decree with proof of filing from civil authorities

What I submitted was an original affidavit and it had the necessary govt stamp. Everything was in english as well.

Since, this may require a lot more time or be making a personal trip to India my attorney suggests getting a statement from an attorney in India stating that an islamic divorce is a legal divorce in india and does not need to be registered. At the same time submit the information on the dept of states website stating that islamic divorces in india are legal and do not need to be registered. Basically, highlighting the information as evidence.

I did even call dep of state, but on Friday apparently they were closed. I wanted to get an affidavit from them confirming the information the website. I even spoke to an officer at USCIS and she said if I can do that. But, still worried what if USCIS is persistent in recieving what they want and deny my case. I can get this evidence sooner than the actual decree, but I was thinking of using that as my last resort.

I know my situation maybe out of the ordinary, but I am in a dilemma. But, time is clicking away and we are in touch with everyone in india to get the information, but there is that possibility that the court may require more time. The thing is I am legally divorce and have been for a long time. If my divorce is recognized in India as legal why should USCIS make me get some more documents. This is insane and its causing unnecessary delay and stress.

Yes, i need some good books or something...VJ burns me out if i'm on it too long...been on facebook doing some games but that gets old, been getting the house de-cat-haired in our spare bedroom for some Canadian family coming next month for their Yankie/Canadian marriage, they're moving to Canada THEN doing a spouse petition once he's there! Good luck on that one, the guy's gonna go nuts not being able to work...been there done that....lol

Had my 2hour skype talk with Nigel Saturday..sure missed him...I hate just weekly talks but he's working working working, thank goodness the pound is still more than our dollar! He's keeping busy but well, i'm bored out of my tree, Nigel's got packet 3 almost done, has to print off that barcoded one though...I told him to get his shot record done this month too....soo, slowly but surely like good ol' gov't...lol

We have been apart about 1 1/4 years (damn economic crisis). But at least we are older adults (both in our 40s) and we are less impulsive. We know how to wait for the good stuff. But there is always that breaking point.

Tonight, I spoke with Leidys about finances. Money is real tight - (Grad school ain't cheap), but I have a ton of stuff I can sell in order to fly her to Los Angeles. I would forgo the interview, but because I previously filed a K-1 in nearly 2 yrs ago, I know it would be prudent to be there. I hope Attaya takes some picks of everything while she is in Dakar(?). My consulate is in a transition to some new online forms, so I couldn't get a heads up on a few things... I got some stuff, but a lot of the forms I couldn't do ahead of time... also due to being out of the country for a month.

I was hoping to mail the packet 3 back today, but I have NO money to mail stuff, until I go to the bank and exchange a bit of cash I have from my trip into Canadian currency... work sucked so much today I didn't get to get out to the bank and post office before it all closed, so now I have to wait until tomorrow. It's frustrating... I just want to know when my stupid interview will be!

So, on that note, it was nice to see a bit of good news from other people on the thread. Congrats Starlight and endoftheroad!
