I have been dating my UK fiance for a while now, and we are sick of doing the back and forth thing! He is coming over to the States on a J1 Student Gap Year Visa this June. We thought we had an idea about the process, and looking through these posts proved otherwise..

our story:

He is coming over to the States on a J1 Student Gap Year Visa this June. This Visa is a 5 month work and travel Visa, during which we were hoping to begin the immigration and marriage paperwork. He is due to leave early November, 2009.

We are looking to begin paperwork ASAP and get married ASAP as well.

Can I petition for his fiance Visa while he is over on his J1 Visa?

If so, how long does that petition take? I have been told 3-6 months (hoping this is true)

Could his Visas overlap? or would ha HAVE to go back to London for his medical appointment and such.

Also, does anyone have a general outline of the costs for everything (i keep seeing different ammounts).

We are students and have limited resources, so the cheapest, easiest way to do this would be great!

ANY ADVICE WOULD BE GREATLY APPRECIATED

Also, what should we be doing in the meantime in terms of evidence of the relationship and what not.

visas would not overlap as he would be required to return to London thus ending his J-1 status, in order to get a new visa....

DO NOT get married while he is here on the J-1 as the K-1 will be no longer an option. If you do get married then a spousal visa (CR1 or K-3) would be needed

I remember reading that from K-1 to AOS was about $2800. I'm not sure if this value included removing conditions two years later or not.

You can look up amounts, but basically some costs I know of are approximately....

K-1 petition $455

Medical exam $???

Visa at Embassy $131

AOS about $1100

Removing conditions $???

Incidentals, like photos, courier mailing of packets, etc $???

I remember reading that from K-1 to AOS was about $2800. I'm not sure if this value included removing conditions two years later or not.

Probably does and a few other incidentals

I-129F for K-1 = $455

K-1 Visa fee - $131

Medical = varies by consulate could be up to $300 or more

I-485 = $1,010

I-751 = $545

Incidentals - varies

thanks guys! also, does anyone know if there is a certain time he must remain in his country after his J1 student gap year visa? i keep hearing that with some J1 visas its a 2 year minimum before one can get another visa.. but to my knowledge the J1 gap year is different??

I would expect that the 2 year minimum is before one is eligible for another J1 visa, but check with the consulate.

I would not expect any kind of restriction to be placed on a K-1, unless a person actually has a ban from the US.

He may need to file a waiver for his J1 residency requirements, depending on the agency he came to the US with.

Well, ok.

What about a CR/1 visa? Could they relocate to the UK for 6 months, then apply for a CR-1? That may be another option?

(not sure how long a waiver takes to process for a K-1?)

Well, ok.

a requirement served or waived is a requirement served or waived and applies equally to the affected classes of visas, not just "K's"
