It sounds like you have your bases pretty much covered. Why the bond?

You have some nice pix; I especially like the one with the young boy hiding his face as you guys kissed. It's like he's saying "aww man, do I have to stand beside you too while you do that? lol

11. Written statement confirming citizenship.

12. Passport copy.

Is this good enough, advice please?

Do you have the W-2's for 2007,06,05? Each copy of the 1040's needs the corresponding W-2.

The W-2 for 2008 will need the corresponding 1040 - I take it you didn't file yet?

But everything else is more than enough.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Good point, I read other postings where people were asked for 2008 returns at the interview (well before the upcoming filing deadline). You should have these ready.

I think someone is confusing an AOS interview with a K-1 interview. The question about the I-134 indicates this is a K-1 interview in Kiev, Ukraine. The Kiev consulate is usually very family friendly. You have enough financial documentation, more than enough, Kiev only asks for one years tax returns. As far as eveidence of relationship, bering all you have, why not? You will be surprised that they ask to see little if any of it, but let them make that decision.

Not sure why the bond, I guess because the cosponsor has a bond.

You are right, my fiance as well as his dad, the cosponsor didn't file yet. And I was a bit concerned that those three previous years' tax returns do not have w-2's. Do you think it will be a problem if we provide other assets, letter of employment and stuff?

It really depends on the consulate. Everything I have looked at says to include all supporting evidence, and for the 1040's, a W-2 is supporting for it.

Some embassies use the I-864 for guidance, and that definitely says to have W-2's with the corresponding 1040's.

But considering all the other info you have, it should be sufficient, if not, they will give you an RFE at the interview.

Is there any chance you can call the IRS and have them fax your transcripts over? Takes about 15 mins or so, and it includes everything you need to satisfy the requirement.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Kiev will be looking for ONE year (2008) tax return with w-2s/1099/schedule C (whichever applies). That is what I provided in Spetember and will provide again in June for our son's K-2. Our interview was "no questions asked"
