Do you need to draw up a new Affidavit of support for the AOS process? We hope to submit this in late April 09. We already submitted one as part of the K1 application process in January 09. Would a copy of this one be sufficent?

The affidavit for AOS is different (I-864) than the one used for the K1 visa.

Do you need to draw up a new Affidavit of support for the AOS process? We hope to submit this in late April 09. We already submitted one as part of the K1 application process in January 09. Would a copy of this one be sufficent?

You would need a totally different Affidavit, as Anh map posted about. (I-864).

For all intents and purposes, the I-134 is "finished" now, you can't reuse the old one.

However, you can use the same evidence for income for the then form. (Plus, if you haven't all ready, you will have to show 125% of the poverty level for the 864)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Great, thanks. It doenst mention that we have to get the I-864 notarized in the instructions like the one for the K1 visa. Is this the case?

the K-1 also does NOT need to be notorized.

Yeah, they removed that requirement.

AOS (I-134) for K-1 covers only the period from entry to getting the green-card NOT beyond.

An I-864 is REQUIRED from the person who filed the I-129F, and is required to be included in the I-485 packet.

Is now a US Citizen immigration completed Jan 12, 2012.
