Hello

This is my first time posting. I just have a general question that hopefully someone can answer for me. I have a thai fiance who is visiting me right now in california. She is over here on a tourist visa. I do not know much about the visa process. I was planning to fill out all the paperwork and send it in to get married, but my fiance was talking to one of her friends today and her friend told her that since she is already over here on a tourist visa, then the only thing she needs to do is to go get married and then change the visa?? Is this correct? All feedback is appreciated.

Uh...nope. Not correct at all. Was she your fiancee before she arrived on her tourist visa? Timing is everything. What paperwork were you planning to fill out?

yup, if you were engaged and she went visit you with a tourist visa and you're planning on getting married it is a problem. If you proposed to her after she was there (in the states) then it's another case.

if you wanted to do the no hassle easy route, put in the application for the fiance visa now while shes in the country. that way you can run off some of the waiting time together as long as she leaves the US before her visa runs out, then when she returns to her home she can complete the process and come back all legal and above board when her fiance visa is approved.

If you're looking for a process that will minimize your time apart, I would follow m_olask's advice. If you marry here, she will have to go back home and you will have to try to have her immigrate as a spouse... much longer process, given people's experiences here....

lol i think he meant he calls her his fiancée. First you have to propose to her, then you start your petition from there, she'll have to return to her country. But that's the best way if you don't want to be apart too long. Good luck! :thumbs:

One thing I know, if she came here just to visit you, without thinking about marriage while on her visit, then it's ok to get married and then apply for adjustment of status (where both of you go to the interview for the green card). You can tell when a person comes here intending to get married or not just by looking at her luggage. So, if you're not lying that she didn't come here this time to get married and that you were indeed thinking to start the K1, then don't worry... I know plenty of couples with stories like that.

I know a couple who did just that. After they got married, they applied for AOS. I don't really know the details, but I know it wasn't easy, or cheap. They had to hire an attorney and pay a hefty fine. This was 2 years ago, I'm not sure if things have changed since then.

The best route for you both is to go and have a consultation with an immigration attorney who specializes in family based immigration. After getting the specific facts related to your case (what was included on the B visa application, what was said in the B visa interview, what was said at the POE when entering the country, and other factors), the immigration attorney will be able to guide you on what can be done and risks that are involved. All of those and other factors could have significant bearing on your case. What you may believe is not significant may turn out to be significant in the process. An attorney will help you figure that out.

Do not do what is easy or what appears on its face to be easy. FInd out what you both really want, your timeline, and what your needs are, weight out the various immigration options, and then choose which route you want to take that fits your needs...

That is so not correct. It is NOT illegal to marry in the US on a visitors visa nor using the VWP. What is illegal is intent to immigrate. If one enters (granted entry), and there was no intent to immigrate, and one is otherwise eligible, one can adjust status (do a quick search of USCIS site).

To the OP....do as zyggy suggests and consult an immigration lawyer.

Start now by downloading all packet 3 forms for a fiance visa. Start collecting all information requested in these forms. Take pictures of each other and save airline tickets etc. (proof of meeting in person). She will need to take this information back with her to the Bangkok Embassy eventually. Make copies of everything!

This is the fastest, easiest, legal, and most honorable thing to do. You will find everything you need on this site. I did this with my wife and the time went by very fast. Contact me if you need my help, or go to the "Sawasdee 2" topic and ask.
