We always seem to end up at the slowest processing center, this time VSC. We orginally sent in the I-751 in February; they rejected saying we didn't pay for my daughter's biometrics, even though I stated in the cover letter that she wasn't included on the I-751. They didn't do their math and she was approved 101 days after me for the AOS so she didn't qualify to go under my removal of conditions, they were trying to say she was approved within 90 days of mine (her approval date was July 11). We already knew we were up for an additional $545 because of their mess up two years ago.

Anyways we resent the package to them, not listing either of my daughters (one is with her dad) with another letter explaining that she didn't qualify to be filed under mine and that we will be doing hers when the time is right, and paying the extra fee.

Well two weeks on, and nothing, nada. No check cashed, no NOA, not even another RFE. My GC runs out on Thursday. Will they be responsible if I lose my job, our house, car and everything else because of their incompetence?

I know we can't sue them, they are untouchable. But does anyone have any suggestions as to what we can do? We tried calling but without the magic receipt number we cannot get any information from them. We are so stressed out by this and don't know where to turn for help.

They have been some cases in which check is cahed 3 weeks after they receive the petition. I hope your case is just like them.....

if you mail your case using USPS tracking system, you should have the signature, then you should be fine

Almost the same thing happened to us. I screwed up and put my adopted US citizen daughter in Part 5 of the I-751. It did say list ALL children. They sent a notice requiring the biometrics fee for her. I'd also explained she was a USC in the cover letter and included a copy of her US passport. I resent the I-751 without her on it. Still no biometrics for the wife. Called the 800 number and did a couple of Service Requests. Nothing again.

I finally called my senator. His immigration specialist was HOT. She called her contact at USCIS and things moved FAST. Got the biometrics and a short time later the 10 year GC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

We also got very good help from our senator and was almost tripped up by listing ALL OF OUR CHILDREN when only the ones that are tailgating the applicant, but on the N-400, using the same identical phrase, there you list all of your children.

We did send the I-751 overnight with a return receipt, but with the N-400, no big deal, just sent that first class mail, ironically our N-400 was processed in a third of the time as the I-751. Made me wonder if they intentionally delay the I-751 when you request a return receipt. See all of you are going through the same thing we did over a year ago now, nothing has improved over the last couple of years, that is still a crime in my book.

We received the RFE on the 14th February (Saturday) the letter was actually dated the 6th. We sent back the corrected I-751 on Monday the 16th, overnight. They signed receipt for it on the 17th at 12.30pm.

We tried calling them on the 1-800 number but they won't even attempt to look at it without a receipt number.

I will call our senator about it and see if they can do anything. Tomorrow is D-Day and we are sweating it really bad as I have a government job and we are sure they are going to call me tomorrow about work authorization.

Did you send a check? You can check the back of the check they write the receipt number in the back. At least the one for the NOA.

We sent a check and it hasn't been cashed as yet, so no receipt number from that either.

I called our senator today and his immigration person has put in a request for information on my case, hopefully we will hear something by tomorrow.

I don't want to jump the line, I just want to know if my case is alright before it is too late. I guess now that if it isn't then I am pretty much up a creek in a barbed wire canoe without a paddle.
