Timeline

We filed the 129 and 130 in January and they both got approved March 22. I just called NVC and they told me that they already received the 130 but it hasn't been processed yet and that the 129 was sent to the embassy in Colombia yesterday. We don't want to continue with the K3 visa, we decided we want to proceed with the CR1. Since the 129 was already sent to the embassy, won't the k3 visa be done before the CR1? What can we do so that the CR1 will be done before the K3 so that I could get CR1 instead?

05-11-2009: RFE thanks to the lawyer again and his assistant.

05-12-2009: RFE package sent to NVC

05-14-2009: NVC received RFE package

05-27-2009: Case finally complete!

K3 Visa

There is a chance that K3 will be slightly quicker. However once your spouse comes to US you have to refile change of status for them to get a green-card. It is another 3-6 months procedure with finger printing and all the bells and whistles plus $.

with CR1 route, you wait another 2-6 weeks and arrive in the US and get green-card in mail. No more immigration hastle.

thats my take. I had abandoned K-3 process and am working on CR process.

We are going through the same process. The Embassy has already sent Ivonne the first packet for the K3 visa. We are just going to ignore the K3 process and continue with the IV. It may take a couple of week to a month longer, but the advantages far outweigh the little bit of extra time (plus I get on a plane Thursday for 10 days in Bogota :dance: . Our IV fee bill has been received and I will pay the fee online this weekend. By the way, make sure your spouse's name is EXACTLY the same on the birth certificate, baptism certificate, and passport. We have to get Ivonne's documents corrected due to her spelling her middle name differently than what is on her birth certificate. That exact match is a requirement of the Embassy in Bogota and it is stated on their web site. Also, the visa packages are also available on the Embassy's website due to problems with local mail delivery (although Ivonne did receive her K3 package in the mail without any delays). so do I just ignore everything the embassy sends me about the k3 and just answer CR1? Won't I get in trouble for abandoning that visa? Sorry for asking so many questions I just want to make sure I'm understanding everything.
