Well I have gone thru all the steps for my wifes visa so far, the I-129, I-130 approved and sent to the embassy in Thailand. My wife has received her packet had her physical and security checks everything is pending. Now I found out that my sponsor (I currently don't make enough on paper) has bailed. Without a sponsor I am lost, Im not asking for help just venting. It is so frustrating to of gotten so close and now be so far away, right now there is nobody I can turn to that I can think of at all. Maybe a miracle will happen but right now the future looks very dim. Please do not tell me to have hope, any more hope and I wont know what to do with it.

Well I have gone thru all the steps for my wifes visa so far, the I-129, I-130 approved and sent to the embassy in Thailand. My wife has received her packet had her physical and security checks everything is pending. Now I found out that my sponsor (I currently don't make enough on paper) has bailed. Without a sponsor I am lost, Im not asking for help just venting. It is so frustrating to of gotten so close and now be so far away, right now there is nobody I can turn to that I can think of at all. Maybe a miracle will happen but right now the future looks very dim. Please do not tell me to have hope, any more hope and I wont know what to do with it.

Don't wait for a miracle, go find another sponsor.

How short are you from making the poverty level do you need? Perhaps you can sell some assets (or even claim them as assets) to meet it?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You are asking for a K 3 visa it seems. Because of that you wouldnt be able to use a co- sponsor anyway. The K 3 requires the use of the 134 form & the Embassy in BKK will not accept a co-sponsor.

You are right with respect to hope if your former hopes were based on bad information or understanding of the requirements that led you to believe otherwise.

Sorry to hear of your troubles. If you are close to the poverty line, maybe you could find a second job for a few months? Even something like a Saturday in a shop or two evenings a week in a bar or fast food place will add up....

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Where can I find out for sure about sponsorship? Does the Sponsor for the I-134 HAVE to be the pettioner? I know I will have to find a cosponsor for the I-864, and I was planning on using that person as the sponsor for the I-134. As for povery guidelines and working another job or something, that is not remotely viable. And as for assets, what I have would take alot to replace but has such a low value that is not valid either. If this is true about the I-134 most likely this will of been a big waste of time on both of our parts.

Check with the BKK embassy as to whether sub/co-sponsors are accepted for the I-134.

As well as ask in the Asia:East & Pacific regional forum here on VJ

We already know BKK doesn't accept co-sponsors for the I-134. The OP's open choice is the CR1 visa path with a new joint sponsor. Absolutely, BKK will require an affidavit of support from the petitioner and if they don't qualify, no joy.

CR1/IR1 with a qualified joint sponsor using I-864 is the only available solution to the OP's problem at this time.

Facts are cheap...knowing how to use them is precious...

I hope those of us that have advised you on such seriouse matter do so from direct knowledge & experiance. A VJ member just went thru this very problem & they found out by contacting the BKK Embassy directly. The Embassy advised them of what we have told you.

The best way to know that the information is correct is to never accept the information or advise of another person that you dont know or trust. This means to contact the Embassy yourself. Use the # 2 email address to do so. They may or may not get back to you. If they do it will be exactly what you have been told already.

Unfortunatly your only path to success is to file for a C R 1 & find a co- sponsor.

Sounds like you're just as certain as I am and for the same reason. If the only way we could know something is to experience it first hand, we couldn't be much help to anybody. Sure the OP can confirm by email but in the meantime, he needs to get cracking on the CR1. In this case we learned what we "know" based on the recent posting of the policy in writing by the Embassy itself.

So since I have an approved things approved, what is involved in a switch to a CR1 and an estimate on time. The entire point of getting her a visa was so that we could earn some money before sailing and leaving the US. I was ready to leave the US before I met her, I would like to show America to her but it is becoming more trouble than its worth.

Given the constraints on Thais traveling outside their country & your apparent desired lifestyle it absolutely is worth it in my opinion. The visa would free her to do as you wish.

The VJ member pushbrk has a lot of experiance & quality advise for you here. Follow the advise; trying to get a co-sponsor & complete what you started if at all possible. You are almost there & have spent the time & money to get almost thru a difficult process.

We hope you succeed in finding someone to help with the sponsorship aspect.
