K1 Employment Affidavit Not Requested Yet!!!

Wow... how to begin? ... from the beginning i guess would be good!!! :) :) :) lol

I see many posts for the employment affidavit, but, when is it requested?

We have the appoint at the consulate coming up in about a month, but I have not received anything asking about my employer or how much I make... or anything like that!

Is the employment affidavit always requested, or just sometimes?

Should I be worried?

Mar-01-08 Met

July-18-08 Got engaged (inside a plane while flying)

Nov-03-08 I-129F sent

Nov-06-08 I-129F received by Vermont USCIS

Nov-14-08 NOA1 - Letter received confirming acceptance of application

Mar-02-09 NOA2 - Approval notice received

Mar-06-09 Letter informing file was sent to local Consulate where interview will take place

May-07-09 Appointment at Consulate in Rio De Janeiro (VISA approved)

May-12-09 TNT envelope delivered with VISA

May-26-09 Arrived in Miami

Are you talking about the I-134, and the letter from your employer?

If so, that is required for the interview.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You need to get on it quickly and take it to the interview. Fill out form I-134 and include as much income history as possible.

3 years of history should do it (tax transcripts are sufficient) . You will also need a letter from your employer on company headed paper stating how much you make and what job role is etc..

If you have a co-sponsor then repeat the above.

I thought it was odd... the employment letter should be sent with the I-134 form?

since they have not requested I have no clue where to send it to.

You dont send it , you take it to the interview . Have a look here on VJ, there's plenty of stuff relating to I-134 and the interview stages.

To be clear.

The Petitioner (the Sponsor) needs to fill out and get evidence needed for the I-134 (tax transcripts/letter from employer/etc..), sign and date it, then send it to the Beneficiary prior to the Beneficiary going to the interview.

Make sure as the sponsor you read the instructions, and ensure your income level is 100% above the poverty level detailed here I-864P, you will have to figure out which amount applies to you.

Depending on the embassy, they may require 125% of that level, State department requires 100%.

My question here is are you the petitioner, a USC, or the respondent. If you are the respondent they don't really care too much about income because you will have to find a new job but they do ask in one of the packet 4 forms. If you are the petitioner, the I-134 is very easy to do. One place many people get messed up in is that the I-134 and the Instructions for the I-134 are two different downloads. As Murphy would have it, not all places that have the download for the form also have the download link for the instructions. Those may come in handy to many people, eh? YOu get your last 3 years income. Now if your interview is soon, HURRY UP AND FILE YOUR 2008 TAX RETURN. YOu can use that one, 2007 and 2006. as the last 3 years.

Just to be clear, 100% above would be 200% of. I think you mean above 100% of the poverty level or above the 125%. Since all Consular officers know you'll soon need to file an I-864 requiring the 125%, it would be good to get a co-sponsor if you don't qualify at that level.

Just as an aside, it's always been a pet peeve of mine when advertisements say 3 times MORE effective, when they mean 3 times AS effective because 3 times more effective is actually 4 times AS effective etc.
