Hi everyone,

Just when I thought things could not get more complicated/stressful, I just found out today that my co-sponsor is basically backing out on me. My fiancee's interview is in three weeks! I feel like I need more time to make sure that I can find someone else and get all the sponsorship forms redone (don't want to have my SO go in for the interview and not have everything they ask for). My question is, can appointments be rescheduled at the request of the applicant? Is this difficult to do and does the embassy look down on these requests/use them as a reason for denial? I don't want this to cause any problems, but I don't know what else to do. Also, if anyone has ever asked for more time, how soon would another interview be scheduled? I am afraid that this one complication will delay us for months! Please help with any advice or insight you have.

Rescheduling is not going to have effect on the outcome of the interview.

I don't know how soon they can reschedule, but it is possible that it will be for months.

Try as hard as you can to get a cosponsor before the interview. Three weeks is a lot of time.

Have you explained to the one who backed out that the I-134 is not legally binding? Maybe that is what they were worried about.

If it was me, I would still go to the original interview. If the CO is not satisfied then they can approve the visa pending a new cosponsor and they will probably set up a time for your fiance to come back and turn in the documents. To me, that is a better alternative than trying to completely reschedule the interview. Will it be difficult for your fiance to get to the consulate multiple times?

Hi Zee,

Thank you so much for always responding to my questions/crises!

My co-sponsor is actually my father, and I believe that he is having second thoughts now because of pressure from my mother and other family members who don't agree with my relationship. She has told me that she doesnt want to be responsible financially for my SO. I had read in the posts that the I-134 is not legally binding and told her that, but when I gave her the forms, she got nervous because of the fiancial obligations that are stated there. What is the purpose of the I-134 if the financial obligations are not really enforced? I know that I would still need their help in co-sponsoring for the AOS support papers (864??). This form, I am assuming is the more serious and legally binding one, right? I am worried that even if I can somehow talk my father into going through with the I-134, that something will happen and he won't want to do the AOS support papers. If this does happen, could I get someone else to co-sponsor for the AOS support requirement? I know that's awhile off and I could definitely have something else worked out by then, if needed.

Although I-134 is not legally binding or enforced, as your mom (like any other mother), will feel bad by thinking that she let you down if you and your SO do need financial help later and she or your father can't help. Did the Consulate tell you that you need a sponsor or do you think you need one because of the guidelines? Anyway, it doesn't make much sense to reshedule because I-134 is not the only document that determines the visa approval. Let your fiancee go to the interview as schedule with what she got.

The I-134 is used for all kinds of nonimmigrant visas like tourist visas so its more of a guideline to use for K1 visas.

You can have different people be cosponsors for the I-134 and I-864. The cosponsor does not need to be related to you. They just need to be a USC or LPR, 18 years or older who meets the income requirements.

hey bluehill and zee,

thanks for your input. as for your question, bluehill, i need a co-sponsor because my income in recent years has not met the guidelines. i have been more focused these past years on being in ghana with my fiance and not here in the U.S. working and making money :) which puts me in a bad spot now, needing help from my family to sponsor him.

Is your current income enough? My past income was mere pennies, but at the time I applied for the visa I was making enough money and they were ok with that.

12-01-05 - Picked up visa!!

AOS:

12-25-05 - Flight lands at JFK - EAD stamp

05-15-06 - Green card received!! Woo-hoo!!!

05-09-07 - Our first son born!

03-12-08 - Biometrics

12-12-08 - Card production ordered! Yay!

It's so painful reading your story. It's even more painful 'cos if anybody is going to let you down in times like this, it should not be your own parents. Gosh, I really really hope they'll change their mind for the better. For the next week or so, take your time explain things to them well, I'm sure it's not thier intention to make life stressfull for you, gosh I hope not. Calm and tone down your voice when explaining things to them, expecially your mother. Looks like she's more worried about the financial obligations. Now is the time for them to stand up and make you happy. GOOD LUCK SIS!!!!!

PS: I like Zee's idea. once you get an interview date from ghana consulate, rescheduling should be your last and certainly most desperate option. You got three weeks, search for and use all available options to get a co-sponsor. USPS EXPRESS takes about 3-4 days to mail packages to ghana from my experience. Don't give up on your search for a co-sponsor yet.
