Customs issues - coming back into the USA

Has anyone ever had any problems coming back into the USA with an expired green card and the one year extension letter? My husband and I went to the UK a month ago to visit friends/family and had no problems coming back. He went back to the UK for 5 days without me and coming back in thru JFK they pulled him aside - in a nasty way and questioned the heck out of him! They even went as far as to question his extension letter saying it could've been fake. They kept him about 20-30 minutes. Good thing he had an hour and a half layover! Is there anyway to complain about how they treat those that have all of the proper documentation?? He's afraid to travel anywhere until the 10 year green card comes - and that's probably not until July at the slow rate they are moving!

December 8, 2005 - Married!

January 20th - TSC recieves AOS packet along with EAD petition

January 24th - Recieved NOA1 for AOS and EAD

February 15 - RFE for I-485...request another copy of birth certificates.

March 9, 2006 - Notice that the RFE Documents were received by USCIS

March 10, 14, and 15th 2006 - I-485 TOUCHED!!!

March 23, 2006 - Recieved Biometrics appointment for April 14th for AOS/EAD!!

April 14, 2006 - I-485 and I-765 TOUCHED!! April 18, 2006 - I-485/AOS - TOUCHED!

April 20, 2006 - I-765/EAD APPROVED!! (90th day!) April 24, 2006 - EAD card ARRIVED!!!

April 25, 2006 - Went to apply for SSN...told to come back May 12th!?!

June 9, 2006 - Hubby received Social Security Card! - July 19, 2006 - AOS Touched!

July 28, 2006 - Received Interview Letter! Interview is August 24th - 9:30am

August 24, 2006 - Interview. Approved pending infamous FBI check...

September 27, 2006 - Received welcome letter!

September 30, 2006 - Rcv'd e-mail (3) that the green card has been ordered.

October 5, 2006 - Green card received with error!!!

October 6, 2006 - Sent I-90 form - they received it October 10, 2006

November 17, 2006 - Infopass...received temp I-551 stamp good for one year.

December 19, 2006 - Received corrected green card!

July 1, 2008 - Mailed I-751 to Texas Service Center

July 3, 2008 - TSC received I-751 packet....the wait begins!

July 9, 2008 - TSC cashed I-751 check.

July 12, 2008 - Recieved NOA1 - 1 year extension letter. - July 30, 2008 - Rcv'd Biometric Appt for 8/21/08

April 13, 2009 - Recieved approval for 10 year green card!!

Probably just a nasty agent on a bad day. I think they randomly pick people to be nasty to so the idea of a tough customs remains up in the air so people don't try to abuse it?

I'm sorry he went through this, I am going to Brasil on August and hope I don't have these issues.

Customs did this or was it passport control?

That's one of the reasons that I refused to travel and move, of course there are other reasons like the application fees took up all my savings so I don't have money to pay for the air fare and got stuck in a little bitty rent place (ain't got money saved to buy a house). :blush:

I'm sorry that happened to your husband. If he wrote down the customs name, he might be able to make a complain. But all they're going to say is "sorry, will do an internal review that leads to never ending investigation = no result needed because you're going to give up/ not enough patience to fight with them". Also, unless there is recording with voice, then it's a "you say I say" case. Too bad the burden of proof always lies on us, not lies on the government to prove otherwise, that's the attitude after 9/11. :innocent:

6/9/2010 - Check cashed

6/11/2010 - NOA in my mail box

6/17/2010 - Able to see case status "Initial Review"

6/18/2010 - LUD

7/2/2010 - Called mis-information line to put in a service request for STILL HAVEN'T RECEIVED "FP NOTICE"

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

I'm really sorry that happened to him- a similar situation happened to my husband while he was with me and our two American children in August. It was terrible and I was so angry I swear it's a good thing we had the kids with us or I would have ended up arrested! They were nasty and awful to my husband and his green card wasn't even expired at that point! We won't travel on the expired green card with extension- I know loads of people do without any problems but I won't take the risk. Too upsetting. I will never go through JFK again until my husband has his American passport.

7/6/09: NOA1

7/24/09: Biometrics

10/08/09: Interview

11/21/09: Receive oath date

01/22/10: Oath Date
