hey guys i had just a question

I am sumbitting a I34 and a I864, do i only need to notarize the I34, or should i notarize both? my lawyer said i only need to notarize I34, but i just wanted to make sure of what you guys have done before

For a K-1, you only need the I-134, and if you use the new form, you do not need it notarized.

The I-864 is for when you attempt to AOS.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I-134 is used at the K-Visa interview and no longer needs notarization.

I-864 is used for green-cards either when adjusting status from a NON-Immigrant (K-Visa) or from an immigrant (CR-1 or IR-1 Visa). I-864 has not needed to be notarized for about 4 years now.

Where to File :

You must sign Form I-134 in your full name. (Note: Signing Form I-135 is under penalty of perjury under U.S. law). For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarize after you sign it.

No if you are ingaged to be married to an non american citizen , you have to file the I-134 not the I-864 . Like everyone is telling you , i-864 is for you being married to someone from another country , and the I-134 is only to be filed for a non family based visa . Which a fiancee of an american citizen is not legally your family yet . Not untill you are married , then that person you marry becomes your family due to marriage . If you file the wrong affidavit you will be denied your visa , and you will not be able to get one . You have to file the I-134 do not file the I-864 , lawyers are stupid and all the care about is money . And if they can tell you something that is wrong , then you have problems they know you will come back to them . Thats how lawyers make money . If you dont listen to what iam telling you , then its your own fault . I have gone through allready this in our visa , Co-sponsor use the same i-134 you just print out another copy of the I-134 , and you answer the I-134 as a co-sponsor of your fiancee . And you allso fill out 1 I-134 , as the main sponsor for your fiancee . And send both of those I-134 to your fiancee , so she can take it too the Usembassy at the time of your visa interview .

Lovica -- please forget all about the I-864 and the I-864EZ for the moment. As everyone has advised you, you do NOT need to use one of these forms right now. I am hesitant even to explain what the difference is between the two forms of the I-864 lest you use one anyway despite our advice.

In a nutshell, the following documents need to be completed for sponsorship purposes for a K1:

1) I-134 for main sponsor (you)

2) I-134 for joint sponsor (other person)

Neither 1) nor 2) needs to be notarised.

That's it for right now.

Yep i agree with all this. Do as AaronM says, lawyers are full of it mostly and the directions here are spot on.

Oh okay Man im so confused, what is the difference between I-864 and I-864 EZ?
I-864, I-864A and I-864EZ are ALL used only for GREEN-CARDS, either through Adjustment of status or for IMMIGRANT visas (IR- CR- visas)

I-864EZ is a simplified version of I-864, it is used when Petitioner/Spouse/Sponsor (IS NOT using a joint sponsor, IS NOT using assets, and IS ONLY sponsoring ONE Immigrant) I-864EZ is NOT used by a JOINT-Sponsor.

If your lawyer gave you this form for a K-Visa you should seriously question the lawyer's competence.

The old I-134 needed to be notarized, the new one does not. The I-864 does not need to be notarized. Update your attorney. I bet you paid him enough that you think he ought to pay attention, yes? Maybe suggest he join VJ and scavenge the forums for what to do.
