Hello

My fiance is in India . We did engagement last year. Now I am planning to go there for a week precise to get married. What all evidences for bonafied marriage I can show that should be sufficient. WE don't have anything in joint name. Is the certificate from the court enough??

Thanks

Sudhir

get an affidavit from your witnesses that they did have personal knowledge and witnessed your marriage. lots of format in the internet, pick one that works for your country and have it notarized.

good luck!

The evidence requested is not to prove a wedding took place. Marriage certificates do that sufficiently. Any additional evidence is about how genuine the relationship is, not how legal the wedding was.

Frankly, I think affidavits are a joke. Newlyweds can provide some pictures from their time together including a few of the wedding with family members present. Then be prepared with evidence of an ongoing "relationship" at the interview. Frankly, most newlyweds simply include the "required" documents and skip the "in addition to the required....." which be definition is "not required".

The problem with this advice is that it is just makes too much sense to be accepted as correct. Just look at the follow ups to the post. The term "required" doesnt seem to have enough impact.

We had no problem by simply including what is required. Such as a marrige certificate. There wasnt one question asked.

It seems to me that people from India get a free pass while people from other countries have to wait months or more than a year to bring in a spouse.

A friend of mine was married last year in India. He has lived in the US for about 3 years and does not even have a green yet.

Yet he went to India got married, walked into the embassy 3 days later and his wife got the visa to come to the US. The next week they were in the US.

I'm happy for my friend but what a joke.

Since neither of the people involved are US Citizens, the visa obtained would not be K3 or CR1. It would have been a visa appropriate for their circumstances. Sounds like an H1b or E visa category that allows families to accompany. Has nothing to do with India specifically.

You will be fine with just the marriage certificate at time of filing the I130 and I129F. The additional evidence is only necessary at time of visa interview. So get married, register it, take pics of marriage and people at attendance and mail these with the initial petition. Later when you go back to visit if you do, take some more pics, keep receipts of flight and other expense to show at interview if needed. Good luck.

Hello

Well in just one week time ist not possible to get enough evidence. Maximum we can have a small wedding and register it from the court.

Is it ok if I make another trip to India after few months and then we both can spend some time together and get the photographs etc.

Is it ok if we initially just send the marriage certficate while filing K3?

Do the immigration people verify whether actual wedding took place at that time and venue and who were the present guests ?

Please advice

Thanks

that is definitely not true.. read the I-130 instructions, it asks for proofs of bonafide marriage..

AOS from H1B

04/2/09: Filed I-130, I-485, EAD, AP

04/13/09: Received NOA for all the forms

No, that is not true. Read carefully and interpret literally. All references to evidence of bona fides submitted with the petitions are preceded by the words, "In addition to the required documents....." So, by definition anying in addition to the required is "not required". What the instructions don't remind you of directly in that section is that the I-130 is not just used for newlyweds' visas. It's mostly used for status adjustments by intending immigrants already living with their USC spouses in the US or abroad. Those people are expected to provide such evidence with the petition and newlyweds are not. At least that's what all evidence points to. I've seen two reports of RFE's for relationship evidence and both were London DCF cases, none at all for visa petitions filed with CSC or VSC.
