Hello

My fiance is in India . We did engagement last year. Now I am planning to go there for a week precise to get married. What all evidences for bonafied marriage I can show that should be sufficient. WE don't have anything in joint name. Is the certificate from the court enough??

nope.. just the certificate is not enough.. you need to prove that marriage was not done just to get your fiance to US.. search the forum there is plenty of material on the topic. good luck.

Examples of bonafide marriage evidences :

Pics of Marriage

Pics of you two spending time with each other in different places with different people

Bills and receipts of hotel or any booking done in both name

If marriage was done in India then recommendatuion letters from your fiance`s perents/relatives and if possible from your relatives too.

Package Delieverd at USCIS: March 05, 2009
March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.

get an affidavit from your witnesses that they did have personal knowledge and witnessed your marriage. lots of format in the internet, pick one that works for your country and have it notarized.

The evidence requested is not to prove a wedding took place. Marriage certificates do that sufficiently. Any additional evidence is about how genuine the relationship is, not how legal the wedding was.

Frankly, I think affidavits are a joke. Newlyweds can provide some pictures from their time together including a few of the wedding with family members present. Then be prepared with evidence of an ongoing "relationship" at the interview. Frankly, most newlyweds simply include the "required" documents and skip the "in addition to the required....." which be definition is "not required".

Facts are cheap...knowing how to use them is precious...

Anyway, I sure hope the marriage cert. is good enough but if they ask you for more proof, photos, affidavits, and etc. would be my idea of it. Maybe it's just a cultural thing... third world country ideas and ways of doing things i guess.

I think to be on the safe side you should put in anything and everything that proves the marriage took place, all affidavits, all pics, and they will keep what the need and throw out what they dont. It may or may not be a waste of time, but you would rather be cautious than sorry. My opinion. Good luck with everything!

Well in just one week time ist not possible to get enough evidence. Maximum we can have a small wedding and register it from the court.

Is it ok if I make another trip to India after few months and then we both can spend some time together and get the photographs etc.

Is it ok if we initially just send the marriage certficate while filing K3?

Do the immigration people verify whether actual wedding took place at that time and venue and who were the present guests ?

Please advice

If you are sending your husband money save all the receipts to prove there is a financial connection. Save all emails, chat logs, and phone records. These all show that you have an ongoing valid relationship. I wouldn't send them with the I-130 but would take all these things with you to the interview.

You will be fine with just the marriage certificate at time of filing the I130 and I129F. The additional evidence is only necessary at time of visa interview. So get married, register it, take pics of marriage and people at attendance and mail these with the initial petition. Later when you go back to visit if you do, take some more pics, keep receipts of flight and other expense to show at interview if needed. Good luck.

agreed. But, they wont "throw out what they dont want". It will be forwarded with the rest of the packet to the embassy eventually, which really cant hurt anything. Thats more evidence up front.

Evidence at the interview stage is of WAY more importance than at the petition stage.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

I dont think its a good idea for a wife to show that she is sending her husband money. :unsure: Most cultures look down on this and dont see it as proof, but as a red flag.

humm.. probably right. Our culture here frowns upon it.

Better not show that, unless really asked about it directly. You might get accused of taking advantage of your wife.

take pictures with the officiating officer, with the family, with your friends, with everybody you know. the more the pictures, the better.

Get 1 or 2 of your family members that knows about your relationship to write an affidavit. :)
