Here is my question:

When my fiance moves to Los Angeles, on a K1 Visa. Can he apply for a Social Security # & Authorization for Employment Immediately after we get married ? Does he need a SSN in order to apply for a Driver's License ?

With all of you who has already went through this process, can you please fill me in on more details?

Thank you so much!

SSN - before or after marriage (but before day 76 of entry or he will have to wait until EAD)

1 yr. EAD - after marriage concurrent with AOS application

CA DMV website will tell you what you need for identification

Your fiance can apply for a ssn, but it wont be work authorised until you have been through the aos process.

The requirement for applying for a driving license varies from state to state, best to check with your states dmv website.

Let's say, we get married right away after he relocates to Los Angeles. And we apply for AOS. How long does the Employment Authorization take? Should we apply for a Social Security # then? After AOS or apply right after he arrives? Whats' the best process?

He can apply for an SSN immediately when he steps off the plane. My wife applied for her SSN 16 hours after arriving and had her card in the mail exatly one week after arriving. Drivers license is a state matter. My wife needed the I-797C and a copy of our marriage lisence to get a drivers permit (or lisence).

Apply for SSN immediately, in my opinion. Most banks will need it to add him to an account. Apply for the EAD with your AOS, but don't be surprised if you get the green card first. IMHO it is a waste to apply for the EAD separately ($340) when it makes little if any difference. If getting authorization quickly is an issue, then get married and file AOS as soon as possible.

bolded is not what the guides recommend.

"On the other hand, you should also not file for a SSN too soon either. You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe."

He will apply for his SS number about a week after he gets to the states. You don't have to wait though, he can go apply as soon as he gets to the states and then the SS will just process his case once his name is entered into the system :-) He does need a SSN to apply for the driver's license, so as soon as you receive the SSN, 2-3 weeks after applying, he can go ahead and apply for his license :-)

If he has a stamp on his I-94 that says he is eligible to work, he can start working as soon as he has his SSN too.

You are welcome to send me a message if you have any other questions :-)
