I had no idea where to post this moderaters, let me apologize if it is in the wrong place. :blush:

My fiancee told me that he did not turn in his i-94 on his return trip in January. He says they did not collect them, I have no idea if they did or not. I am worried that it will look like he did not leave the country, and that would put him into what looks like an overstay. Does anyone have any idea how to fix this?

OK.... Well I guess you should check this up, you don't want to be sorry later.... BUT this happened to me once before. I think it was my first time ever in the US... I still had the I-94 when I got back home..... But they SHOULD collect this before letting the "alien" leave the US. They probable already know that your fiancee already left though. So you shouldn't worry too much! :-)

Well I presume he had his passport stamped at re-entry to the UK? That would prove he did not over-stay. His only "violation" is not returning the card. I doubt that would draw more than a "stern talking to". I think there is the I-94s get mailed to and someone here will probably tell you. If that is the case, mail it now. You could even send a copy of all pages of his passport with your petition if you are really worried. He can scan and email you the copies.

funny that it happened to me.

apparently if you used a commercial airline, you should not have a problem. But it is good idea to bring the boarding pass from when you left the States last time, when you go back.

A UK citizen can't have his or her passport stamped entering the UK, or the EU for that matter. A stamp indicates the bearer has permission to enter, which a UK citizen does not need.

Anyhow, from the horse's mouth:

I still have the I-94 or I-94W in my possession; what should I do?

If you have left the United States and are still in possession of the I-94 or I-94W it is in your best interest to forward it to the appropriate authorities so that your record is corrected and that you do not experience any problems on future travel to the United States as a result.

It is very important that you complete the back of the card listing the port of departure and date of departure from the United States and the carrier/flight information. The I-94 or I-94W together with a letter of explanation and evidence of your departure from the U.S. should be sent to:
