hello vj members:) i have few questions here, hope someone can help me out...its about the affidavit of support and itr thing. were applying for k1 visa and my interview will be this coming month of april. my fiance stopped working since 2001 because of an accident and he received benefits from that. but another source of his income aside for his savings is his rental homes. his income is a combination of his benefits and rental homes. i heard about poverty guidelines, thou his above the poverty guidelines but the benefits he received included on that, is that counted as his income, because if not it is below the required income, and were really worried about that. did the approval of K1 visa based only on that? is it the main concern of the consul?how bout his savings and other proof that i will not be a public charge on their country.you think guys it will affect on our visa application? thank you in advance for your help, godbless!!!

Have him set up a DBA (Doing Business As) with the local county office.

Then he will be able to show this as his company, and thus write Employment Letters, etc for himself.

If his taxes don't meet Poverty Level for last year, he can always do a revised Tax and submit that to the USEM and IRS......

He will just have to provide three years of tax returns, showing the income. He can declare the rental properties as assets, as well as any savings. If the AGI on all the returns, but especially his last return, is above $125 of the poverty guidelines, then no problem. Better than working for somebody else, where he could lose his job! I am self employued, and had no problem with the support issue, and no, I did not file a DBA and write myself an employment letter!

hello:) thank you for your time replying on my concern. he already have the 2006 and 2007 ITR and still working on for the 2008, he plan to send me everything this week. you mean as long as his ITR shows that his income is above the 125% poverty guidelines theres no problem? is it matter if the said incomes comes from his benefits and rentals? i heard that disability benefits cannot be counted as income, is it true? aahh so confusing sometimes, were not familiar on those stuff, its not so easy from the start, it seems so hard for us, but still tryin to be positive:)

The disability income can be counted if it is from VA or a federal organization like VA.

SSA is different from SSI and can be counted as well. SSI is public assistance where

SSA is considered an income.

I just looked at the instructions, and I show no provision for periodic payments such as disability, so I can't see whether or not benefits could be used toward showing his income. Does he meet the 125% of the poverty guidelines with just his rental income? I am guessing, but if he has current appraisals for his rental properties and any savings, that could get you and him past the threshold. They want to see assets that can be converted to cash within one year.

(for a co-sponsor thing it will be a problem to us because for now we dont have in mind to be one) thank you for your insight,your so nice to give me time:) honestly my fiance and i did not know about these things, i just being aware when i read some of the post here and im thankful because i started to learn and worried because now i started to know:) lol... i hope everything will be ok for us, im about to get my culture test result by next week and they said will be scheduled for interview in 2-3 days.

both the disability payments and rental income should count. if he doesnt include the rental income on his tax returns, then you have a problem, and need a co-sponsor.

its included in his tax returns, if that so, it seems that no reason to worry then:) haaaayy,thanks god for all your response, its almost clear to me now, its 3am here already and im still awake waiting for replies hehe!!! i can sleep now lol:) godbless
