DO i need to hire an attorny to apply for k1/k3?

99% of the people here do it themselves, that is why this forum was/is created. But after reading here and a few other forums about some headaches and many letters to congress that some people have had to write and some taking as long as 2 years even before the interview date I just wanted a piece of mind. Plus with all these abbreviations, page after page of FAQ and everyone having their own opinion I threw my hands in the air and will let someone else do it. I don't have money to throw away, but I do make a pretty good living so I felt I will let someone else do it that has been doing this for several years while I take it easy and watch TV or read up on some good chinese cultural and history books.

I know how to fix a car (following instructions and diagrams), but what would take me 2 days on the weekend will take a mechanic 2 hours. You get my point?

Timeline

It literally takes less than 90 minutes to put the entire packet together. You would essentially be paying the attorney to ask you for your and your fiancee's name, DOB, address, and a couple of pictures and signatures. Follow the guides step-by-step, fill out each required form, sign them and ship them out. It is easy as 1-2-3

No , you dont need an attorny . You can file on your own , many couples have . All you have to do is fill out forms , and read alot to get the visa . And you can find all that information online , and all members of visajourney are here to help .

We didn't use an attorney. This site SAVED us!! However, the moderators on here have been (as I've read the boards) careful to point out that attorneys are neither endorsed nor discouraged on VJ. So use the services of an attorney if it's the right the decision for you and your fiance/spouse. And GOOD LUCK!!! :thumbs:

We didn't use one and everything turned out just fine. The guides are fantastic, the people are helpful, there are example forms as well as downloads, and a wealth of knowledge and experience that's priceless. It's really whatever you feel comfortable with but it is a very doable process without an attorney.

If you have anything that might not be normal, criminal history, immigration issues in the past like over stays and stuff like that, it might be a good idea as they can make sure the right waivers get filed to try to help decrease the length of delay you will experiance. If yours is very straight forward I would say you can do it yourself, a lot of us did. It just depends on your situation :D

No you do not need to hire an attorney, most are do it yourself persons who have gotten through the process just fine. Unless you have a criminal history, have overstayed in the US or anything else requiring a waiver then hiring an attorney might be a good idea.

These are the two posts in this thread that you should pay attention to. I can add that some attorneys used to be consular officers themselves, and therefore their insights and advice can be worth every penny that you could pay to them. The respondents here who say outright that "you do not need an attorney" do not know your situation and are therefore offering potentially irresponsible advice.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would like to add .02 cents more. 95% of the people that do use an attorney would not even post here. They work with the attorney, everything goes through and everything is happy for all. Happy couple and a happy attorney.

The only time you might see someone that used an attorney here is if they get screwed, so you might get a bad cross section.

I am one of the few that is using one but post and read here to kill the time and make friends.

Yep, totally agree with everybody here. We didn't hire an attorney and we never had trouble with an RFE or anything, so it IS possible to get through this whole process without an attorney :-) And it's a lot easier on the pocketbook :-)

We also have friends who DO have an attorney. Honestly, the attorney does nothing but file the paperwork and make sure everything is in order. They have no way of speeding up your process or getting more accurate answers than you would get if you did everything by yourself. Good luck!

Just wanted to add that they ARE useful though if you prefer not to worry about the paperwork yourself. If your mind would be more at ease to have somebody else doing the paperwork and keeping track of things for you, an attorney may be worth it.
