hi all,

I've been a legal resident in the states since i was a preteen and I've been here more than 10 years. Recently i decided that i wanted to become a citizen but my green card was expired and i had to renew it in order to file for citizenship. So i did a form i-90 and i received a biometrics appointment but i had to reschedule it. I missed the second appointment and due to my naiveté with dealing with the USCIS, i didn't know missing an appointment was so serious, i thought they might just send a new appointment.

Well today i received a letter saying that i abandoned my application and i could motion to reopen it by filing form i-290B within 30 days.

what should i do? How can i motion with a brief? i don't think i have any supporting evidence. can i do another I-90? can i be deported for this?

just file another I-90 and you should be okay. Filing a motion to reopen is way more cumbersome and costs almost $600 while a new I-90 will only cost you $370ish. AND DO NOT MISS AN APPOINTMENT THIS TIME because if your green card has expired, technically you fall into the illegal status but I think USCIS has a certain timeframe where you are still eligible to renew your greencard. For the fastest service, E-FILE!

my green card has been expired for a awhile now, i think it did in my late teens early 20's, i always thaught that when your greencard expire it's just the card and not your status. geez i feel like an idiot.

No, you will not lose your permanent resident status if you do not renew your Green Card–your permanent resident status will not expire or change.

However, you are required by law to carry evidence of your status/registration (e.g. a valid, unexpired Green Card or the temporary proof of status you receive at the time of filing to renew your Green Card.) Also if you fail to file taxes, and had any felonies you might encounter difficulties renewing your green card.
