Would my husband be denied???

Timeline

My husband has a 10 year GC. We have been married 3 years and we are thinking about applying for his citizenship. Here is the question....

About 6 months ago we got into a fight, the cops came and he was arrested for "assault". He was released the next day and eventually the case was dropped after he succesfully attended anger management courses. This is his only offense and he has no other "criminal" records.

Our attorney stated that eventhough it is a domestic violence case it is not concidered cause for deportation because it is not a crime of "moral turpitude". I would like to know if this is 100% correct.

I am scared that he will be denied the citizenship or one day be deported. We have the original document from the court that the case has been closed. Has anyone had this experience???

He would not be deported. As long as he has shown that that was a one time incident he should be fine. I have no experience in the matter, but as long as he does nto show a history of this kind of violence then there should be no problem. Ofcourse that also leaves room for the IO to make their on determination on the case. Best of luck.

It really depends on the Immigration Officer who interviews your husband. Assualt is a "felony" is most states and usually they are a big deal if proven guilty. What was the final disposition of the case? I am asking because its not really clear if the case was dropped after your hubby plead guilty or did you drop the charges yourself? If you drop the charges yourself without him pleading guilty, then there is nothing to worry about but if he plead guilty and in order to avoid jail time and fine he took an anger management issue, that might be viewed as a negative. Sought a legal experts help in such a case if he plead guilty.
