Can someone tell me were I can go to get a declaration of civil status (declaration of single status)? I am in the US and against my better judgement have agreed to wed in Brazil (which I am ok with) and go throught the k3 Process (which I would rather not do). Looks like I will need a Declaration of civil status along with a few other documents to do this. From what I have learned, most couples doing this are already in Brazil and go to the American consulate to obtain this document but what if you are in the US?

You normally get that from the US embassy/consulate.

If your in the US, you may be able to get it from the State department? You should call them and see (the consulate in question)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

From what I've read - you have to do it locally (local consulate/embassy) - it is valid for 90 days.

If you are planning on marrying outside the USA then this is certainly not a K-1 issue.... moving to regional forum

YMMV

I got married in Peru. I obtained a declaration from the county recorder where I live. It went back until I was about 13 years old. I got a certified copy. I had no problems with it in Peru. In Peru they call it certificado de solteria. It's not Brazil, but the declaration should be the same. If it is anything like Peru, you'll need a LOT more papers. I couldn't believe the paperwork!

I always wondered about this. Now I am being serious. How do you "prove" you have never been married? "I'm not married, never have been" OK, here's your document. "I have never been an Olympic marathon runner guy" OK, here's your non-Olympic marathon runner guy certificate, do you need it translated to Portugese? At least THAT would be easier to prove...look at me! I need a nap after DRIVING 26.4 miles!

I know several countries seem to ask for this negative "proof", but exactly how does one do it? Anyone with a knowledge of this, please let me know. I am an Engineer (hey...it's better than being a lawyer!) and so kind of scientific in my thinking and I am just interested as I have never been able, scientifically, to prove something that has never happened.

VERMONT! I Reject Your Reality...and Substitute My Own!
