hello!

I'm just wondering.. Does the affidavit of support given to me by my fiance need to be sent to USCIS? or do I just present it at the consulate once he asks for it? Because my fiance just directly sent me his filled-up affidavit of support form and it didn't pass through the USCIS.. thanks a lot for your help..:)

01/29/09.. Embassy sends letter about having received the application and i can now schedule my interview

USCIS doesn't care how much your fiance earns, so sending you the forms is the proper procedure, because at the interview is where they determine if you become a public charge or not..

Once USCIS approves the petition (NOA-2) your case will be forwarded to NVC for a brief period, assign the NVC case number. This is normally a short period and NVC will forward the package to the embassy. At that point you will be sent a letter or email telling you to download package 3 from the embassy website one of the forms will be the AOS I-134 that your fiancee sent you and 156 & 157 forms which you will fill out.Once you have all the documents gathered you then set up your medical and Interview. You will receive also an instruction letter from the embassy telling you how to pay your fees and how to proceed from there. That's basically how i understand the K-1 process others will correct if process is slightly different to that.

Yes, this is correct. You need to get your form numbers straight. I will give you a link. The short answer to your question is that the form you file depends on the visa you are filing. All visas use I-864 except K visas which use I-134

We are filing a K visa and the I-134 never goes through USICS. So if you are a K visa filer, I answered your question. If you are not, then you need to keep searching for an answer. Since you are in this forum, I assume you are a K visa filer.

Be sure to read this page carefully. It starts out talking about the I-864 but then changes gears and says:

Petitioners of K visas should submit a Form I-134, instead of an I-864.

Unfortunately, for those of us filing at Guangzhou, that "short time" is about 3 months. I have heard several stories why but the person I trust the most told me it is just due to backlog. The embassy told me a story that is difficult to believe. My file left the NVC in mid Jan so my wait will not be a "short time." What your boyfriend is doing is trying to send you advance copies of all of the forms that go in packet 3. Then when you get packet 3, the forms are all filled out and ready to go. BE SURE that you look at the checklists of things you need to take to the interview. Some may take a while to get. Don't get caught sending in packet 3 saying you are all set and then have an appointment for an interview when you don't have all the paperwork. Your police file, not married certificate, Chinese birth certificate and any divorce paperwork ALL must be notarized and translated.

Guys, need your advice. Interview tomorrow. I have a question on the affidavit.

We are having a cosponsor, my fiance's dad. for i-134, i have the following documents that my fiance sent to me:

1. Afi-134 signed and notorized

2. letter verifying employment, salary.

3. Statement from senior officer of the bank.

4. Copy of W-2 for 2008.

5. Copies of tax returns: 2007, 2006, 2005. (for this i have first page 1040 for each year)

6. Copy of last 3 pay checks and pay stubs.

7. Life Insurance Policy

8. Deed to house.

9. Written acknowledgment that a bond will be deposited.

10. Written acknowledgment that such and such will be my sponsor.

11. Written statement confirming citizenship.

12. Passport copy.

Is this good enough, advice please?
