RECALLED PETITION - UPDATE

I just called the VSC and the operator told me that an officer was looking at my case and that an RFE would be sent. I asked her when I could expect it to be sent and she said "within 30 days." She didn't seem very sure of her answer but this would imply that everyone will be getting an RFE eventually.

While rlt received a message that his case is being processed, my online status still says that it was approved April 13, but there was a touch on June 1.

I think the first update you´ll get is the same I did.. "This case was reopened on a USCIS motion..."

I´d like to know what they have to say about that.

What´s happening with the reopened cases.

Ok.

My fiancée called VSC about 2 hours ago.

They said they have almost all recalled cases back now, so they are now working hard on them.

The officer said what takes time is to match the petition they receive back ith something called Alien File. That is what they keep in Vermont for people with approved petitions. That could take a long time.

They told her VSC has already done that to my case, that´s why my status online shows my case as reopened and processing.

Matching the petition with the alien file can take a long time.

I think it won´t take a long time from now. But it´s been already more than a month since they recalled the petitions.. maybe they were working on it and are now puting things together.

They also said ALL OF US will get a RFE. There is no way they can approve any case without the IMBRA part of the form.

That´s the next step after having a case reopened.

The officer couldn´t say when my RFE would be sent, but having the case reopened is definitely a good thing!

They said the RFE will be mailed within 30 days.

I took that as a regular answer. They say that for everything. So I think it won´t be after next week.

Think about it.

The cases are there. They are already reopening them. They know our NOA1 is dated way before the pending petitions and they are working hard on this.

They do have about 1000 recalled cases there.. it takes time, but I think that´s what they´re doing now.

Let´s keep checking our status online. I still do that about 20 times a day...

If I get anything new I´ll post it here.

Please do the same!

:)

I really think is our turn now!

Cool !!!!!

That makes you the first recalled petitioner with a RFE!

Even though we´re not from the same Service Centers I think us from Vermont should be really happy about that!!!!

I just didn´t get one thing: you got a I 797 by snail mail? What´s that ? Did you ever got an update online saying your case was reopened on a USCIS motion?

---

Mike, I hope the info my fiancée got is accurate too!

But it would be good if you could give them a call tomorrow too!

Maybe just to ask what they´re waiting for to send the RFE to the reopened cases!

Always good to keep pressuring them!

I think we´ll get something this week! It´s only monday!!

I don´t know if I´ll get a I797 as well, since my lawyer receives the mail and he´s not that helpful.

Anyway, because you´re the only case recalled from CSC at VJ I was wondering if it was recalled due to IMBRA, but it certainly is, right?

I hope your situation gets resolved very soon!!!

It is really ridiculous the way these recalls are being handled. They should at least have the courtesy to let us know about these recalls. I was in complete dark until I saw the information on this site. My petition was approved on April 21,2006. My girlfriend has been waiting for her packet for almost 2 months---and now I find out about this.

GREAT NEWS all you RECALLS out there! I just checked online and HALLELUJA - finally an update from CSC that reads as follows: "On June 26, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed."

NOA1 - March 6 (Nebraska)

NOA2 - March 31 (Nebraska)

NVC sent file to Paris April 12

Fiance recv'd pkt 3 from embassy April 24

Fiance returned pkt 3 May 5

June 16/17 I rec'vd emails from CRIS-USCIS petition "received" (I assume by CSC)

June 24 rec'vd two I 797s in mail, case "received" and "reopened" by CSC

June 26 - online update that RFE is IN THE FREAKIN MAIL  B) :energetic: :goofy::star::content::content::dancing::dancing:

RLT - Yes, I did get the online update and email about my case being reopened on a motion by USCIS. The two forms I 797s I got in the mail Saturday look just like the NOA1 and 2 NOTICE OF ACTION forms, but with less said on the front, just that the petition was "received" from DOS along with their request that it be reviewed; and the other notice said that after review, the case was "reopened" and I will receive notice under separate cover once all action has been completed. Then I recv'd the online status update this afternoon about the RFE having been sent today. WOOHOO!!!

That´s awesome news!

Thanks, RLT. Same to you. I think something positive is starting to happen, based on today's thread. 2 senators saying kinda the same thing, me getting an online update, PLUS, I just got an email verifying the online update. I should know for certain within the next couple of. days if it is indeed the long awaited /much maligned IMBRA RFE that arrives in my mailbox, as I am in Portland, OR, and mail usually takes a couple of days to get here from CA. I will let everyone know the details as soon as I get the RFE.

I have wondered, too, whether my petition was recalled from the embassy in Paris for some other reason than IMBRA, but given the dates, and the fact that nobody has said it is due to something else (i.e. the dreaded AR) I am sticking to the story that this is all about IMBRA> B)
