It would be excellent news if they just sent the petitions straight to the consulates..but are we sure this will be faster? Think about it, what if they use diplomatic mail which they collect in batches and send together? Then again another few days here or there, what's the difference after 2 months of waiting?

What I really hope happens soon is that the approvals start pouring in this week, it certaintly has been long enough!

I also fear VSC sending it directly.

Sounds to me they would return it as the Consulate did.. all together. I hope it goes the regular way. VSC - NVC - HOME.

But Lewis was not the first one to be told that.

We´ll see. Maybe this week?

Hi rlt and Sleepless in Oregon,

I'm tucking this into this thread for now. I might do a new thread after we have more info. But wanted to let you know now as you have shown interest. Soooo.....

Last Thursday my fiancé turned on his cell phone and viola ! there is a message from the Paris consulate dated July 10. (I could have kicked him for not checking his phone sooner but it's his France number and he wasn't expecting any messages.) A woman, not leaving her name, said our case is still pending in the States because it took 2 months to reunite the case making it a long wait (reeeeaaaaaally) and we should be receiving a form soon (double reeeeaaaaaally).

She then said there may be a way to get married faster and to fax her with a phone number to call him at to discuss it. So we sent off a fax today, hoping to hear this week but knowing we may not get a reply.

Now isn't that bazaar? Why would the consulate call? We were told by Paris in May there were 30 cases being recalled due to the law change. Would they call all of them? Sleepless- you didn't receive a call so I assume not.

What do you guys think about this? I will post any further info when we get some.

Cheers! And may the universe rain rfe's and approvals upon all of us.

Tres bizarre, Americanwoman!!! I asked my Fiance last night if he had herad from the Paris embassy and he said no - and he usually has his cell like strapped to his ear. Maybe I will try to fax the embassy - do you have contact details there? I tried to call them last spring and was charged almost $20 to tallk to a guy in a call center not even located in Paris who knew less than I, and advised that we needed to appear in person at the embassy on Friday afternoons only, to try to get in to talk to a live body. Not convenient, as I live on the other side of the globe, and my fiance at the opposite end of France. Let me know if you find out more!!! Very interesting!!! :hehe: B)

If anyone does call your embassy, please do not mention this. I do not want to piss off anyone at the consulate. I think they are more than likely thinking of a K3 or DCF (which doesn't apply to us) but we'll see...

A friend also suggested that maybe they're fishing to see if he is really only looking for a green card. But she may be paranoid because she is French!

Sleeples - where is your fiancé from? To far from Paris to go on a Friday? We never got any solid info via phone either - the call center people do not have access to all the details of a case (so we were told).

I really hope they call!!!!!!! Today!!!!!!!! Curiosity is killing the cat in me!

No way do I want the SC to be responsible for sending over seas! That just means the cases will sit on someone's desk unitl they get to it! NVC has been quick to get the cases out and they have the system to do so. The SCs don't so how would they do it? Oh right, they would think about it, mess it up, put it on hold, try a different system...... in the mean time I reach retirement age!

It's been almost 90 days now since I recieved a call from the Moscow embassy telling us our interview was being cancelled and our application returned due to Imbra. Since then I have recieved no new information, our case has not been touched, and I've recieved no RFE. This despite repeated cals, inquiries, and a request for expidite.

I have been traveling away from this board for a few weeks and my question is this. Is there anyone left that is still in the dark like I am? I have no idea what to do next. Our complete approval and interview process initially took less time than has passed since they cancelled our interview.

I would add how sad and upset we are but then everyone on this thread understands that.

Hi. Yes, Unfortunately there are more people in the same situation.

You might wanna check this thread http://www.visajourney.com/forums/index.ph...0652&st=165

and see the chart with all the info we have about recalled petitions.

Even though some cases have been reopened and got the RFE being sent, no one from VSC has been reapproved yet.

I feel for you and hope you get good news soon.

Hi.

Sorry to start a new topic for the recalled petitions, but the other one is getting too long and confused as well.

I check my status online all the time, and they just updated it.

It no longer says "This case has been approved...'

It now says:

"On June 22, 2006, we received this case back from the Department of State for further review. We will mail you a notice when our review is complete or when we take other action."

My case was recalled on May 17th due to IMBRA, and I didn´t get any update since then.

I´m surprised they don´t mention anything about RFE.

What should I think? Does it sound bad like a new security check thing or they will finally mail me the RFE?

Also, on May 24th I got an email from NVC saying they sent my case back to Vermont, which I confirmed this week with their officers.

Strange they got it back from DoS.

Why do you think that is????

EXCUSE MY IGNORANCE BUT WHAT IS IMBRA

International Marriage Broker Act

An ill concieved (some would debate this) law designed to protect immigrants from abuse at the hands of their nasty criminal American fiances.

For some of us IMBRA is better known as the root of all our suffering.

Great news!!!

I just got off the phone with USCIS center - I was trying to get information on the status of all the recalled petitions, and asked if USCIS has announced internally any new policy or procedure on how they are going to finish processing these cases. The first operator was nice, sympathetic even, but she did not have anything new to tell me. I asked for her supervisor, who was also pleasant, but said that, no, they had not received any internal briefings or updates on how to respond to my questions. They were both familiar with the fact that many K-1 petitions were hanging in limbo, but did not know how to respond to the question of why so many petitions are being approved that were submitted after March 6 and subsequently put on hold.

The supervisor said the standard time for processing an RFE is 60 days. They had not received instructions to say anything different for recalled K-1 petitions.

Today there was a flurry of NOA2 approvals out of CSC, but none of these were recalled cases as far as I can tell, and there seems to be no systematic pattern by NOA1 or RFE dates. So if USCIS has had internal discussions on what to do about the recalled cases, they are not sharing with anyone. I am so depressed.

I also called USCIS yesterday and my state representative today and I asked if there is any new procedure for the recalls. Both said as far as they knew it was just a matter of time to have the petition sent on to the consulates and they did not know of any new policy involved. My representative said the NOA1 is basically pointless until this IMBRA backlog is done, so if anyone's case is already being processed with the RFE presently they will receive notice soon. I also looked at the lag times of 3 CSC approvals today and I think they were 19, 18 an 13 days from the time the RFE started processing to approval.

I have been very moody and miserable due to all of this lately and I feel frustrated also but I will continue to mine for info from different sources on the recalled situation. If the patterns hold true, the recalls may start seeing action soon. Personally, I don't expect mine to come through until early August. I was very happy to see Cigarovich tracked down his lost petition, hopefully the others will follow soon. May all of us have great news soon.

I've checked lots of timelines to estimate how long they take at VSC to process RFE's and it takes from 6 to 26 days. And for CSC, as Lewis said, it takes the average 16 days I got for VSC... So I guess all of us who have had RFE's sent back and acknowledged won't have to wait too long now. We'll have them approved any time now, you guys. We're very close to getting an approval.
