RECALLED PETITION - UPDATE

That's good thinking, I don't see any reason we would get an rfe, our cases were already approved. And i think you are right, they probably already know which companies are marriage brokers and hopefully they will reapprove our petitions soon. But hey, we are dealing with the USCIS, which means anything is possible.

No that I disagree, but if that is the case, why would they recall the petitions?

If they only reopened my case yesterday and will actually start to perform new background checks now, instead of sending a RFE, that could take ages...

I don't know why they recalled them. Maybe the embassies and consulates can't do the checks they will do. Maybe they will only send the RFE if there is evidence that you have a criminal record, or previous petition, or marriage broker. Why would they need our signature to disclose nothing to our fiance(e)s.

I just got the new message you got earlier that that it is now being processed. The word processed, means they are working on our case not thinking about sending the RFE.

In all, this is great news that we have actually got some action, and can track what is going on. It is a huge relief to know they have it and are working on it.

I submitted an expedite request at the beginning of the week, has any of you that have received these emails done the same?

rlt,

My case has been touched every day for the last three. And today I got this one:

"

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status:

On June 22, 2006, this case was reopened on a USCIS motion, and the case is now in process. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

"

My case was returned from the consulate on 18-May and I believe VSC received it on 5-June. So I'm hoping that by the end of next week I'll have the RFE.

New update on my case!!! I was touched again today, even though the current status says the action was taken yesterday

What do you think? My case is now in process... sounds like a good thing, right?

Anyone else got one of those??

Good luck to us. We deserve it!

:)

elizaxyz,

I would suggest getting your Representative involved. I've contacted mine and got them the information. They are able to talk more directly and get better information than us. It may not speed the process any, but at least it will give you more information (hopefully).

Just got off the phone with Vermont. Still no record of my application since May 1. They have yet to match my petition back with the file that was recalled from the National Records center. The woman on the phone said "I don't know what to say. It's just a waiting game now."

I'm about 90% certain that we're going to sh*tcan this application and move to the UK instead. My lease is up at the end of October; if I haven't heard anything by the time I visit the UK in July, I think we'll apply for the UK visa.

Mike, I hope you´re right. But I think this is your opinion.. processing mean they are working on it, and if they need to send a RFE, they will...

I think they need the signature because the new law says so. It´s like applying with the new form, which we should have done.. we just didn´t have the chance. But the form we used was not compliant with the new law.

That´s why I think we need the RFE. (and this is only my opinion too).

Anyways, now they are processing it, which means they will do whatever they need to do.

This is great news, especially because some of us are in the same status. Seems like is the actual regular procedure for the recalled cases and we did not fall under any crazy thing.

Answering your question, I did not send the request.

Also, do you guys know if they can touch the case more than once a day? Do they do that?

Like, is there any chance I can receive another email today?

Hey, rlt- I hope this turns out to be good news for you- and for me. My fiancee was scheduled for a June 6th interview in Rio- travelled a few hundred miles from the Sao Paulo burbs to be interviewed on that date as well. Was notified AT the interview of a "procedure change"- i.e. this IMBRA debacle- which they didn't explain.

I've yet to recieve touches or e-mail updates, but, best of luck to you- and hopefully, to me too! :)

PS- do they update you via e-mail automatically at the address you use to register with USCIS.gov??

RLT, I got two today. I got both emails and status updates both today. So in the email they sent us, it states they will email us a decision. What decision is there to be made if they are just sending the RFE?

really??

that´s terrible. but i was told it happened to more people in Rio.

I get emails, yeah.

but you need to enable the email option on your account.

I don´t know. I really don´t.

Maybe that´s the message they will be using for all recalled petitions.

But I think they know what to do. What do you say?

I mean, if they finally opened our case, it´s because they do have a plan...

should we call and ask?

Same here.........nothing new.

Of course, I can't even get VSC to acknowledge that they even have my case despite NVC saying they sent it back two weeks ago.

At least some people are getting updates and touches so hopefully we'll all be hearing something soon.

Yeah, Jello, same with me, I know it's there but they won't acknowledge it, that can be very annoying. I let my senators and my representative know about it. I still think it will be ok, it's just a matter of time.

My opinion here.

I got an email from NVC on May24th (almost a month ago) saying they had sent my case back to Vermont.

Of course they didn´t get it only yesterday.

I think they only put into the system yesterday. Before it was just there waiting for them to figure what to do with it.

No, apparently they do. So they opened it and will do whatever they need to do so they can consider the case approved.

That´s probably what will happen to all of the recalled petitions.

If they didn´t get to you yet, they will be doing it in the next few days. Remember they work on weekends too.

Now what I need to know is how they will process my case. if they will request a RFE or not. I think they will.

There are people (with only NOA1) receiving emails saying USCIS got the RFE (IMBRA) back and the process won´t be as long as the processing time states, since they had already done some work on their case before.

I think the same thing will happen to us.

Well, since many cases have been sent back from the consulate in Rio on the same day, I guess we - who have our cases dealt with in Rio - will be getting updates really soon.

I'm really happy for all of you who have been touched. :) I'm happy for you guys and for me as well. It can only mean things will actually start going somewhere.

As you've said on a previous post, my guess is that they will indeed send us RFE's so we can fill out the part that was missing from the I-129f form. We were supposed to do it because the law was already in force and we missed it because of them. In any case - meeting through MB or not - they still need to get the info, even if we - or our fiances - are to say no to meeting through an MB, and to criminal convictions.

I only offer advice - not even legal. Just the plain and simple kind.

I was reading my current status for the 10th time today and am now thinking of something.

It looks really similar to what I had when applied at the very beggening of this journey.

I think it´s the same text, only that it now states REOPENED.

Do you think (even though they don´t change my receipt number) it is now counting as I had only applied now. Like, my case is starting today?

Could be in the sense that now your approval will depend on your IMBRA info, like, let´s say you reply but don´t send the certificate (if you had to) then you´d get another RFE, meaning your process is not approved by default anymore.
