RECALLED PETITION - UPDATE

finally got touched today. Case was re-opened July 10. I got the same email message as everyone else, something about "further review" etc.

It only took them 6 weeks to get it back from Moscow...

Maybe I should have read my message from USCIS a bit better. Case has not been re-opened, they just informed me that it had been received by VSC from State:

"On July 10, 2006, we received this case back from the Department of State for further review. We will mail you a notice when our review is complete or when we take other action."

Anyone gotten this message before? I have seen a lot of messages about cases being re-opnened, but none about informing petitioner that the case had simply been received back.

i think that does mean it's reopened. it does say it's under review. and this message is very similar to the ohers. anybody else agree??

Should I be worried?

Our case hasn't been reopened and there has been no message of any RFE being sent. In fact all the times I called the VSC or NVC nobody could locate our case (or bothered to try). Emails to the NVC and the Moscow consulate on the matter went unanswered.

Rick, Did you learn anything from the DOS? How are they involved and what did you ask them? I'm about to tackle this problem full time including contacting congress, etc but I don't want to jump the gun. I seem to be one of if not the last one to get any update. I'm so happy progress is being made with others but this is scaring the ####### out of me. We're so helpless in this process. I'm even considering filing a Freedom of Information Act request just to know what the h*ll is going on. Probably I'm over reacting but the emotional impact of knowing we would be together right now and having my own government act so inpetly is too much. My fiance (wife) put it well when she noted that to these government people we are less than dust

DoS gave me more info than any other when i was trying to find out why our case was recalled. i have recommended to many people to try them when CIS & NVC don't help. the woman who helped me was friendly and compassionate as well! they have computer access to all cases (they knew exactly where our case was) so they should be able to help you.

Milestogo has sadly turned out to be behooving name for ur predicament. After being told repeatedly by the Manila Call Center, our petition had not been recalled, I called DOS in mid June and the lady said, "oh no" "oh no" your pet has been recalled and all I can tell u is that it arrived back at the NVC on May 29th. She added she had accesss to no add'l info..that it was back in the USCIS's court. She indicated USCIS tells people to call DOS and they are often mad, but they have no access to add'l info. My congressman's imig specialist tells me DOS blames USCIS for this mess and the fact that they are expecting a deluge of reapproved pets to hit them. I pointed out the NVC physically transferred these pets to consular posts and later indicated in a MEMO that their computer search identified the 1100 pets (now est at 12,000) to be recalled so they must have known what was going on. It is interseting to note that Gary Bala prominent Imm Attorney has indicated the USCIS indicated they usually have 6 months to conform to new changes, so one wonders why the recall occured after the Bush speech on immigration? By all means call DOS and call your congressman/senator and be BE SURE TO POINT OUT TO THEM THAT YOU HAVE FALLEN WHY BEHIND THE PACK FOR NOTHING RELATED TO YOU. THERE IS A CONGRESSIONAL LAIASON PERSON THEY CAN CALL. Take care, Rick

Milestogo, it may be small consolation, but you're not quite the last person to get an update...count me in too! After e-mailing NVC they finally told me they had received my recalled petition from Manila and had sent it along to VSC on June 29. No news or updates since...if I were to say I was getting antsy, that would imply the last several months have been a breeze - which they haven't been! It is frustrating...it's been almost 2 weeks, and even the slowest mail service in the US shouldn't take that long...I figure I give Vermont until the end of the week, and then call and ask if they've received it yet.

Today I got an I-797C notice of action in the postal mail that is saying what I already knew, my case is reopened. It mentions it is a "courtesy notice" sent to me because the official notice was sent to my lawyer. It also mentions "any relevant documentation included in the notice was also mailed as part of the official notice". I will call my lawyer tommorow to ask if this was the actual RFE. Hope so....

Sorry 4 being such a reac'tnly radical ( I grew up in Mr. Jefferson's town) but what's wrong w a protest march parade at VSC at St. Albans ( although I live and work in VA and NC) I have relatives in Montpelier (ALOT OF COUSINS, AUNTS, UNCLES, 2ND AND 3RD COUSINS) that could find us places to stay and we and shown signs that say we miss our love ones....emplyoees we know u are victims too of the mis management of IMBRA (my Rebublican Imm Spec Char IMBRA as such, i.e., miss appication of IMBRA and I vote voted Carter, Clinton and Kerry).. we hear it in your inability to be compassionate when we get thru with our disparging cries for help...we are here to protest mis management of IMMIGRATION per se, and the the disreregard of the Life ACT. WE JUST WANT DEMOCRACY AND TO BE WITH OUR LOVE ONES ASAP.

WHAT WOULD JESUS AND THOMAS JEFFERSON SAY about this radical view??????????????????????????

i just got the email about my case being reopened today. i was a bit worried, as my fiance only received his notice of the recall from the embassy a little over a week ago - about a month later than everyone else! but it seems we are now right back on track with everyone. that in itself was a relief to us...

Don't get me started on the Gov. I come from a family with a very long history of Military service and Law enforcement. I worked for the State of Ct for 2 1/2 years in Law enforcement and had to leave because I did my job and was considered a "Boy Scout". I suffered through my Stepson's 1st tour of Duty in Iraq and have another serving in the Airforce. I suffered when Conn. decided to go with a "No Fault" Divorce system that allowed my X wife to take 1/2 of what I own after raising Her kids to be selfless Civil Servents. I have watched the Law in this country to be made nothing more than a Political Football and a Sham. I had absolutely no respect for Law Breakers before... Now to me, the Law I used to believe in and worked to support is just a joke. Politicians are out of control, they take away certian Civil Liberties while Magnifying others that benefit whoever is lining there pockets.

Now the Gov gets to tell me who I can Marry?

Or at least make it so difficult that it is not worth it to wait?

I am losing my Faith in Western Society, Im tired of the Agenda of the Silent 5th Column.
