Timeline

My husband and I will be married for 2 years in august. He has been in the U.S since December 08. I've heard that waiting for the 2 year anniversary of our marriage will make it better! I just want other opinions so I can do everything right! I wanted to get E.A.D first so he can have his work permit so we can gather money for the A.O.S. Fyi My hubby is here on a K-3 Visa!

Do you think that is an ok idea?

What proof do we need to save for the A.O.S for our marriage?

Any info will be so greatful!

Does anyone know a site or info to make sure I file the E.A.D correctly. It seems very easy just want to make sure I do it right the first time!

I had someone help me before and all he did was take my money so I would to handle this on my own!

The only reason I can think of that it is better to be married for two years before filing the AOS is that he will get a 10 year permanent resident card instead of the 2 year conditional permanent resident card, other than that I doubt there is anything better on it :)

As for EAD and the AOS... if you file AOS, you get the EAD and AP for free, so it is better to file everything at once if you ask me. That is, of course, if you have the money for the AOS alone (1010 dollar).. if not, then you have to file EAD first which costs something around the 350 dollar (dont know the exact amount but it is around this one).

The EAD is indeed one of the most easiest forms of all I think. .but if you want to be sure, you should check here for the example forms: http://www.visajourney.com/forums/index.ph...p;page=examples and click on the guides on top of the site to see the guides to everything, they will help a great deal. The proof that you will need for the AOS procedure is also listed in the guides.

N400 Timeline:

12/14/11 - Sending out N400 package

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!

hmm. I will be in the same situation very soon. I am moving to US on May 1. I was going to adjust my status right when I move as my 2nd year anniversary is March 2010 and I heard it could take a long time to process AOS and I wouldnt mind saving some money for filing everything at the same time.

So does that mean if a K3 apply for AOS before their 2nd year of marriage, we would get only a 2 year green card? then we have to lift the conditions? or file a new application with more fees?

Drawback to waiting for 2 years to get the 10 year GC is if the petition should go belly up or divorce before getting the GC the beneficiary will be deported.

I DID THE SAME THING.

Applied just for EAD ....and...I waited for 2 years of marriage for applied to GC.

I am very hapy with my decision.

i wonder if anyone has ever filed AOS 90 days to their 2nd year of marriage and given the 2 yr GC b/c the AOS interview or the GC was approved before the 2nd anniversary? That would really suck to lift conditions real close to your 2nd year.

Yep, been there done that: AOS interview was 10 days before 2nd anniversary, but due to adjusting from a tourist visa, had to file for AOS asap and was happy even with a 2 yr conditional green card. The immigration officer also said that the removing conditions process does not always result in an interview. I think she said that because our AOS interview was mostly a formality (we were not grilled) and she thought we will sail through the removal of conditions, as long as we send in a complete file.
