Hello everyone. I am a little unclear on some of the specifics of the CR-1.

Assuming my wife and stepkid's applications are approved, I know they must enter the US within 6 months and that we will also have to file before our 2nd anniversary to remove the conditional status.

What I am unclear on is:

  1. With the K3, she can enter/exit the US at will. Can she do the same with the K3?

  2. If we were to visit a 3rd country, would she have to get a visa through Russia or could she travel as a conditional US resident? I am thinking specifically of visiting Europe. As a Russian, she needs a visa.

Uh? if she has the K-3, she can multi-entry.

  2. If we were to visit a 3rd country, would she have to get a visa through Russia or could she travel as a conditional US resident? I am thinking specifically of visiting Europe. As a Russian, she needs a visa.

Since she is *not* a citizen of the US, yes, she would need a visa from Russia to visit places that require it. The conditional residence is just for the US, not other countries.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

K3 visa is beteen the USA and Russia with multi entry, anything other those country you will have to request visitors visa for that country you are visiting. Certain countries you don't need a VISA if staying a short time. Before you visit whatever country you plan to visit, google it and see if you need visa from them because you dont wanna get stuck there!

Before we got the K-3, we asked about the visa requirements for Ireland, they told me that Yizhen could travel with me(US citizen) as long as we had proof of our marriage. They didn't even ask about immigration to the U.S. I think it would be the same for most countries in Europe, but I am not sure if that is true for Russians. I would call the Embassy here in the U.S. or the immigration office in the country/ies you want to visit and check on the policy concerning spouses of U.S. citizens. Good Luck, Mike & Yizhen

Whoops!!! Typo. What I meant was is the CR-1 a multi-entry visa? (Goes to show how brain-damaged all these documents have made me.)

as far i know CR1 is for single entry within six months and than you get your green in few weeks when you enter to USA, woohoo.

the CR-1 is a single entry visa but when you enter you will be issued a conditional green card which you can travel on.
